협상에서의 제3자의 효율성과 형평성 증진 역할

국문 초록

분쟁관계 또는 거래관계에서 중개인으로서의 제3자의 조정역할의 필요성과 중요성에 대해서는 널리 인식되어 왔으나, 정보조정역할과 그로 인한 효율성과 형평성 기여효과를 분석한 연구는 거의 찾아볼 수 없다. 협상당사자간에 비경합성(nonrivalry)의 특성을 가진 프로젝트의 경우 일방이 모든 비용을 감당하여 수행 시는 수익성이 없으나 비용을 분담하여 공동으로 수행하는 경우 비경합성으로 인해 그 혜택이 관련 당사자 모두에게 돌아가 수익성이 발생하는 경우가 적지 않다. 그럼에도 불구하고, 프로젝트로 인한 수익에 대한 정보의 불확실성, 예측 수익성에 대한 협상당사자간의 의견 차이, 그리고 상대방의 예측 수익성에 대한 정보가 부족한 미비정보상황 하와 미비정보 비용분담 회피노력과 무임승차 문제로 인하여 협상이 지연되거나 협상자체가 아예 결렬되는 경우도 적지 않다. 위 문제를 해결하기 위해 프로젝트에 대한 각자의 진정한 가치의 보고를 유인하는 여러 조정장치가 제시되었으며 조정장치의 시행에서의 장치조정자의 예산균형역할과 강제역할은 기존연구를 통해 널리 알려져 있으나 장치조정자의 정보조정역할과 그로 인한 효과를 분석한 연구는 거의 찾아볼 수 없다. 본 논문에서 객관적 제3자가 장치조정자로서 조정장치 시행에서의 정보조정 역할을 수행하여 효율성을 증진시킬 수 있고 다수의 효율적 조정장치 존재 하 협상당사자들의 이해가 조정장치간 상충하는 상황에서는 형평성도 증진시킬 수 있음을 살펴보았다.

영문 초록

Necessity and importance of a middleman as a third party in conflicts and trade is widely recognized. But, not much research has been done on the subject of the role of middleman in coordinating the information and its impact on promoting efficiency and fairness. Some project like a basic research have a nonrivalry nature such that many parties can share the fruits of the project. Given the nonrivalry nature of the project, there are cases in which the project is not worthwhile if each party takes the project separately and pays the whole costs but it is worthwhile if related parties take the project jointly and share the costs. However, when values of the project of parties are private information, a simple cost allocation scheme among parties may result in misrepresentation of values or free rider problem. One can induce the truthtelling of values and achieve efficiency by using a demand revealing mechanism. The roles of mechanism coordinator in the execution of a mechanism to balance the budget and to enforce the terms in the mechanism are well known in the existing literature. But, we can hardly find works that analyze the mechanism coordinator's role of information coordination in the execution of a mechanism. In this paper, we show that an objective third party as a mechanism coordinator in bargaining mechanisms can promote efficiency through its role of information coordination. And, we also show that it can promote fairness when there are many efficient mechanisms and the payoffs of each party differ among mechanisms to choose.
