중국 부부재산관련법제의 고찰

국문 초록

오늘날 세계 각국의 부부재산관련법제는 다양하다. 본고에서는 특별히 중국의 부부재산제를 검토하고자 하는데 그 이유는 다음과 같다. 첫째, 과거 중국은 우리나라와 정반대로 법정부부재산제에서 공유제를 택했었으나, 2001년 혼인법 개정으로 별산제를 가미하였다. 이와 반대로 우리나라는 별산제법제인데, 최근 별산제에 공유제를 가미한 2개의 부부재산관련법 개정안이 제출되었다. 그러므로 완전법정공유제에서 법정별산제를 가미한 최근의 중국의 부부재산관련법제를 검토하는 일은 중국과는 반대로 법정별산제에서 법정공유제를 지향하려는 우리나라의 최근의 부부재산관련법제의 논의와 연구에 많은 시사점을 줄 것이기 때문이다. 둘째, 중국과의 상호 교역의 폭이 넓어지고 한․중간의 국제혼인이 증가하는 등 양 국가간의 교류가 심화되면서 한국인과 중국인 간에 채권채무관계의 법률상담 및 법적 분쟁사건이 증가하고 있는 현실에서, 중국의 부부재산관련법제를 파악할 필요성이 제기되기 때문이다. 이러한 점에서 본고에서는 중국의 부부재산관련법제를 소개하고자 한다.

영문 초록

Reviewing the system of matrimonial property in China has two implications for the Korean system. First, recent studies in Korea, discussing a move from Separate Property System toward Community Property System, can benefit from an opposite trend in China. Unlike Korean family law with Separate Property, Chinese family law has adopted Community Property. However, the most recent Chinese family law, revised in 2001, includes several features of Separate Property. Second, growing interactions of Korea with China demandbetter understanding of Chinese property rights regarding marriage. Increasing trades and international marriages between Korea and China have produced many cases of financial credits and debts, some of them resulting in lawsuits. This study examines property rights regarding marriage in China.
