국문 초록

온라인 플랫폼은 팬데믹을 경과하며 사회경제적 가치와 영향력은 비약적으로 확대되었고, 그 가운데 문제성정보 범람과 개인정보 침해 등 초국경적 이슈를 확산하였다. EU와 OECD는 플랫폼을 광범위한 온라인 서비스로 정의하며, 국제사회는 이들 플랫폼에 대한 규제를 요구하고 있다. EU의 디지털 서비스법과 디지털 시장법을 통해 규제를 강화하고 있지만, 한국은 정책의 일관성 부족으로 아직 명확한 규제 프레임워크를 구축하지 못하고 있다. 한국은 글로벌 경쟁력을 갖춘 플랫폼 기업을 보유하고 있으나, 혁신과 소비자 보호, 공정 경쟁 간의 균형을 맞추는 데 어려움을 겪고 있다. 따라서 EU 규제를 모델로 일원화된 규제 체계를 개발하고, 과학기술정보통신부와 공정거래위원회의 역할 분담을 통해 온라인 플랫폼 규제 기본법을 정비할 필요가 있다. 이 연구는 강요적 강제적 자율규제 도입, 알고리즘 투명성 강화, 플랫폼 사업자 책무성 강화 등 법·제도 개편 방안을 제안한다. 나아가 자율규제 시스템 활성화를 통해 표현의 자유 논란을 최소화하고 규제 실효성을 높이는 방안을 모색한다.

영문 초록

Online platforms have rapidly expanded their socioeconomic value and influence throughout the pandemic, and in the process, have fueled the spread of cross-border issues such as the proliferation of problematic information and infringements of personal information. The EU and OECD define platforms as a wide range of online services, and the international community is demanding regulations for these platforms. While the EU is strengthening regulations through the Digital Services Act and the Digital Markets Act, Korea has not yet established a clear regulatory framework due to a lack of policy consistency. Korea has platform companies with global competitiveness, but it is having difficulty balancing innovation, consumer protection, and fair competition. Therefore, it is necessary to develop a unified regulatory system modeled after EU regulations and to reorganize the Online Platform Regulatory Framework through role sharing between the Ministry of Science and ICT and the Fair Trade Commission. This study proposes legal reform measures such as the introduction of mandatory/enforced self-regulation, strengthening algorithm transparency, and clarifying the responsibilities of platform operators. In addition, it seeks ways to minimize controversy over freedom of expression and increase regulatory effectiveness by activating the self-regulatory system.
