비시장경제국가에 대한 미국과 EU의 대체국제도 연구

국문 초록

냉전이후 체제전환과 함께 사회주의 국가의 WTO체제로의 편입이 가속화되면서 국제무역영역에서 이들의 지위에 대한 논란이 계속되어왔다. 특히 WTO협정에는 비시장경제국가에 대한 구체적인 규정이 없어 각국은 자체적으로 관련규정을 두고 있다. 그 중 본 연구는 비시장경제국가에 반덤핑규정을 적용할 때 가장 논란의 대상이 되어왔던 대체국제도에 중점을 두고, 가장 발달된 대체국제도를 보유한 미국과 EU의 제도를 분석하고 그 문제점과 발전방향을 논하고 있다. 이를 위해 본 논문은 세계에서 반덤핑 피소회수가 가장 많은 국가이자 비시장경제국가인 중국의 반덤핑사례를 인용하였다. 본 논문은 서론, 비시장경제국가와 대체국에 관한 개념과 관련규정, 비시장경제국가에 대한 미국과 EU의 대체국제도 분석, 대체국제도의 문제점과 발전방향, 그리고 결론으로 구성되어 있다. 현행 대체국제도는 그 시행에 있어 불공정성, 예측불가능성, 자의성 등의 문제점을 가지고 있다. 또한 시장경제와 비시장경제의 양분화를 전제로 하기 때문에 그 중간지점에 있는 체제전환국가에 적용하는데 한계가 있다. 이를 위해 향후 체제전환국가의 시장경제화 단계에 맞는 다양한 방법들이 논의되어야 할 것이다.

영문 초록

Since the end of the Cold War, the socialist countries have undergone the transition from command to market economic system, and accelerated their shift to enter the WTO system, which led to controversy over their economic status in the area of international trade. Because the WTO agreements do not have the specific regulation on the nonmarket economies("NMEs"), member countries have regulated the NMEs matters by their domestic laws. Among them, this article focuses on the surrogate practices, which has been one of the most controversial issues in antidumping cases involving NMEs, analyzes the surrogate practices governed by U.S and EU, and discusses problems and perspective of them. As the means of study, this article uses antidumping cases of China, who is the biggest victim of antidumping investigations as well as a representative of NME. This article consists of five chapters, including introduction, the concepts and regulations of NME and the surrogate practice, the reviews of the surrogate practices of U.S. and EU, the problems and the probable development of the surrogate practice, and conclusion. The present surrogate practice has shown some problems with its unfair, unpredictable, and self-willed practices. Moreover, there exists certain level of limitation on applying it to nations in transition, because the idea of the surrogate practice was grounded in the bipolar assumptions dividing market economies and NMEs. For that, this author emphasizes the need for discussing various ways to coincide with the different levels of transition of NMEs.
