국문 초록

본 연구는 난민협약 비가입국인 태국과 방글라데시의 비교를 통해 법적 난민 지위가 부재한 상황에서도 난민정책이 존재하며 그 내용과 결과가 서로 다르게 나타날 수 있음을 보여주었다. 태국은 난민을 불법체류자로 규정하면서도 국가심사제도를 통해 선별적 보호를 제공하고, 제한적인 자립 활동을 허용하며, 국제기구와 전략적으로 협력하는 ‘묵시적 수용’ 전략을 활용한다. 반면, 방글라데시는 강력한 통제와 귀환을 전제로 하는 ‘명시적 억제’ 전략을 통해 난민을 관리하며 국가 안보와 정치적 이익을 극대화한다. 이처럼 난민정책은 국제 레짐만으로 충분히 설명되기 어려우며, 국가별로 다양한 난민정책이 형성될 수 있다. 따라서 국제사회와 난민 관련 국제기구는 난민정책 다양성에 대한 이해를 바탕으로 보다 현실적이고 차별화된 대응 전략을 마련할 필요가 있다.

영문 초록

This study compares the refugee policies of Thailand and Bangladesh, two non-signatory states to the Refugee Convention, to examine how divergent approaches can emerge in the absence of legal refugee status. Thailand adopts an “implicit accommodation” strategy, allowing limited self-reliance and cooperation with international organizations while formally classifying refugees as illegal migrants. In contrast, Bangladesh pursues an “explicit deterrence” strategy, enforcing strict control and conditional protection based on repatriation, thereby maximizing national security and political interests. The study argues that refugee policies cannot be fully explained by international regimes alone, as state-specific approaches vary considerably. As such, the international community and refugee-related organizations must develop more realistic and differentiated strategies grounded in a nuanced understanding of the diversity of refugee policies across states.
