국문 초록

직접 민주주의 두 축인 우리나라의 주민 발의와 주민투표제를 미국의 제도와 비교하여 미래의 발전방향을 가늠해보는데 본 글의 목적이 있다. 우리의 주민 발의제와 주민투표제는 아직 역사가 일천하여 각 지방자치 단체들은 이제 겨우 조례를 제정하여 실천 사례와 자료와 경험이 부족하다. 그럼에도 불구하고 이 직접 민주제를 실천하여 기존 제도권 정치를 견제내지 보완하려는 노력들이 여러 자치단체에서 적지 않게 시도되고 있다. 이러한 과정에서 여러 혼란과 갈등이 야기되고 있는데 이에 대한 많은 이유들은 이 두 제도가 시민들에게 실질적이고 전면적인 권한을 부여하기 보다는 아직 매우 형식적이고 자의적으로 구성되어 있다는데 문제가 있다. 이는 중앙 집권적 전통, 직접 민주제의 일천한 역사, 기득권, 주민의 자치 능력에 대한 불신, 두려움 등 여러 요인에 기인하고 있다. 미국의 제도는 주마다 그리고 자치단체마다 상당한 차이가 있기는 하나 일반적으로 주민에게 실질적인 발의의 주도권을 주고 있으며 또한 발의를 할 수 있는 정책 이슈의 영역과 범위가 매우 넓다. 또한 미국은 주민발의와 주민투표제가 효과적으로 그리고 실질적으로 이루어지기 위한 주민 발의 과정에 대한 사회적 인프라가 구축되어 있다. 주도적 자율권, 실험, 다양성, 개방성, 교육이라는 직접 민주제의 가치와 이념이 최대한 보장되도록 법적 그리고 제도적 개혁이 요구된다.

영문 초록

The purpose of this article lies in examining the prospects of initiative and referendum in Korea by comparing with and bearing on American initiative and referendum. How they will unfold is a great concern to both academicians and practitioners. There are also all sorts of misfits and gray areas in the provisions of the ordinances that will be contended in the conflicts resolution and deliberation processes of the judiciary. The Korean initiative and referendum is half-baked in the sense that citizen does not control the whole processes of the initiative machinery. In contrast, a well-developed industry of citizen initiative is institutionalized in America where initiating discretion like drafting the initiative proposal, preparation of a ballot title and summary, preparation of a fiscal analysis, and technical challenges are common practices. It is expected that the words and culture of Korean I & R initiative, control, centralization, uniformity, closed mindset, conservativeness, and fear will be replaced by experimentation, openness, participation, and diversity.
