국문 초록

아르헨티나 정부는 투자협정상의 의무를 위배하였다는 이유로 외국인투자자에 의해 40여건 이상 국제중재에 제소당하고 있는 상황을 보이고 있다. 근래 현지국 정부를 상대로 한 외국인투자자의 중재 제소 건수가 증가하는 추세를 보이고는 있지만 아르헨티나의 상황은 특히 예외적이라 할 수 있다. 아르헨티나 정부를 상대로 한 투자분쟁들은 1990년대 아르헨티나의 개혁과 개방정책의 추진, 특히 민영화와 외국인투자의 적극적 유치를 배경으로 하고 있으며, 2000년대 초 경제위기 상황에서 발동된 긴급조치가 직접적인 분쟁의 대상이 되고 있다. 본 논문에서는 아르헨티나 투자분쟁의 상황과 배경, 그리고 구체적인 분쟁사례 등에 대해 고찰하고 있다. 아르헨티나의 투자분쟁 사례들은 투자협정의 의미와 관련 규정의 해석의 심도를 제고하고 있다는 국제법적 측면에서의 의의와 함께, 외국인투자유치 정책 측면에서 효과적인 가버넌스의 중요성을 보여주는 사례들로서 중요한 시사점을 제시하고 있다.

영문 초록

The recent surge in investment disputes arising from international investment treaties is noteworthy. Argentine tops the list of countries having faced investment treaty claims with more than 40 claims lodged against it. As a consequence of the Argentine's economic crisis of 2001-2002, the government of Argentina issued some emergency measures which adversely affected foreign investors' investments. Many of those foreign investors brought their claims against Argentine Government before the International Center for Settlement of Investment Disputes. The Argentine Government is now faced with the possibility of losing most of the cases. This paper examines the backgrounds of these claims and explains three cases where the arbitral tribunal has recently issued ruling holding that Argentine Government violated its investment treaty commitments. The Argentine cases have substantial implications as a precedent for international investment claims relating to economic crisis. Aside from the legal aspects of the cases, this paper emphasizes the importance of the effective governance in FDI policy as a shield against unwelcome claims.
