재가 요양보호사의 근로 현실과 처우개선에 관한 소고

국문 초록

본 연구는 재가 요양보호사의 저임금의 원인이 재가 요양보호사의 법적 지위가 명확하지 않아「근로기준법」등 노동관계법의 보호를 제대로 받지 못한다는 것을 규명하는것이다. 재가 요양보호사는 대법원으로부터 근로자성은 인정받았으나 현행 법령에서는 단시간 근로자 여부를 확인할 수 없으므로 단시간 근로자로서 보호를 제대로 받지 못하고있다. 재가센터에서는 휴일근무수당으로 기본급의 1.5배 지급에 머물고, 휴일수당과 휴업수당은 전혀 지급하지 않고 있다. 재가 요양보호사의 근로 현장이 매우 특수하여「근로기준법」및「단시간 근로자 보호에 관한 법률」의 적용이 모호하고, 근로 현장에서 노동관계법을 자의적으로 해석할 수 있는 여지가 있기 때문이다. 이를 해소하기 위해서는 다음과 같은 사항의 개선이 필요하다. 노동관계법에서 재가 요양보호사와 같은 특수 직종이단시간 근로자에 해당하는지 여부를 명확하게 재정립하고, 고용노동부에서 재가센터 전반에 대한 노동실태조사를 정기적으로 실시하며, 휴일근무수당에 대한 오해를 불러올 수 있는「장기요양 급여 비용 산정방법에 관한 고시」를 개정하고, 재가 요양보호사의 귀책 사유가 아닌 휴업에 대한 생계 곤란 및 부당해고를 막기 위한 법적 근거를 마련해야 한다.

영문 초록

This study investigates the underlying cause of the low wages of homecare workers: the unclear legal status of home care workers prevents them fromreceiving adequate protection under labor laws, including the Labor Standards Act. While the Supreme Court has recognized home care workers as employees, currentlaws do not allow for verification of their status as part-time workers, leaving them without adequate protection as part-time workers. Home care centers typically onlypay 1.5 times the base salary for holiday work, with no holiday or suspension pay. The unique nature of home care workers' workplaces makes the application of theLabor Standards Act and the Act on the Protection of Part-Time Workersambiguous, leaving workplaces open to arbitrary interpretation of labor laws. Toaddress this, the following improvements are necessary: The Labor Relations Actshould clearly re-establish whether special occupations such as home care workersare considered part-time workers, the Ministry of Employment and Labor shouldregularly conduct labor status surveys across home care centers, the “Notice onthe Method of Calculating Long-Term Care Benefit Costs” should be revised, whichcan lead to misunderstandings about holiday work allowances, and a legal basisshould be established to prevent home care workers from experiencing financialdifficulties and being unfairly dismissed due to suspension of work for reasons notattributable to them.
