북한의 경제개방에 따른 외화관리법의 일반론적 고찰

국문 초록

북한은 현재 경제개방과 외자유치를 통해 경제발전을 모색하고 있으며, 이를 반영하기위해 각종 투자관련 법과 외화관리법 등을 제정 또는 개정하고 있다. 그러나 북한은 핵무기발사와 2.13 합의이행에 따라 주변국으로부터 지원을 약속받았기 때문에 외부의 지원이 전제조건이 되어야만 내부 경제성장을 위한 노력이 수반된다. 따라서 본 연구는 6자회담 또는 2.13 합의이행 실현을 통하여 현재 북한이 처한 상황을 개선하기 위해 북한의 외화관리법을 중심으로 외화관리법시행규정, 대외경제계약법, 개성공업지구 외화관리규정, 금강산관광지구 외화관리규정 등의 법리적인 측면과 이러한 외화관리법에 따라 운용되고 있는 북한의 외국환 제도 즉 환율제도 등을 중심으로 북한의 금융 시스템을 일반론적으로 고찰하고 있다. 그러나 북한 경제제도는 너무 폐쇄적이기 때문에 자료의 한계성 때문에 깊이 있는 연구를 하지 못했으며, 아울러 현실적인 환율을 중심으로 한 외환제도 또한 일반론적 고찰에 그쳤다. 앞으로 북한의 외화관련법과 제도 등을 지속적으로 연구함으로써 남북한 경제체제구축과 남북한 경제협력 및 통일의 기본 축을 형성하는데 주요 목적이 있다.

영문 초록

D.P.R.K recently underwent a major experimental reformation in the economic system of open country. This paper in mainly concerned with the discussion that in urgent need of opening country, focusing on the foreign exchange relation law. This paper is analyzed to economic open and North Korea's foreign exchange relation law. it is difficult to see these foreign market as only temporary. but Now North Korea is making rules and laws related to business legislation and foreign exchange law. Todays, North is necessarily international transaction and foreign investment. such as revise to foreign exchange relation and positively activity to foreign exchange. its reform in North Korea must contain directions towards marketization. Marketization is taking place in the level of self-reliance of enterprises, individuals and other terminal actors in the national economy, without the foreign exchange market and physical goods. As we have discussed the results above, it is sure that foreign exchange law reasonable care should consider the laws such as North Korea related foreign exchange management law and foreign exchange control, that is, foreign exchange rate.
