국문 초록

동서간의 냉전이 종식하고 난 이후 세계는 국가간 전쟁의 위협보다는 민족, 종교, 영토, 환경, 자원 등의 다양한 분쟁요인들에 의한 테러의 위협에 시달리고 있다. 특히 미국의 9.11 테러 발생 이후에는 항공기, 고성능 폭발물, 생화학무기, 미생물 등을 이용한 뉴테러리즘의 현상이 확산되어 천문학적 액수의 피해규모와 대량 인명살상은 물론, 발생지역 또한 세계 각국으로 확대되고 있는 이른바 국제테러가 새롭게 전개 되고 있다. 그러나 지금껏 국제사회의 테러대응 협력체제, 즉 12개의 개별 협약, 지역 간의 협약, UN을 통한 공동 대응의 노력 등, 그 어느 것 하나 국제테러에 대한 속 시원한 해결책을 제시해주지 못하고 있는 현실이다. 이러한 문제점들로 인하여 국제테러의 예방은 물론 이거니와, 사태의 발생 이후에도 테러범 처벌에의 실효성이 떨어지며, 또한 테러대응 주체간의 충돌 가능성을 상존하게 만들고 있는 현실인 것이다. 이에 국제테러를 효과적으로 대응하기 위해서는 무엇보다 국제사회가 동의하고 강제력을 부여해줄 수 있는 규범체계인, ‘포괄적 테러 대응 협약’이 채택되어야 할 것이며, 이에는 국제테러의 확정적 정의와 대응 규범체계의 적용 범위 등이 확정되어야 할 것이다. 이와 같은 통일적 규범체계가 형성이 되어야지 만이, 이를 바탕으로 국제테러 대응을 위한 실질적 협력 체제가 완성될 수 있을 것이다.

영문 초록

Since his cessation of the Cold War between East and West, the world is suffering from threat of terror by various conflict factors such as people, religion, territory, environment, resources rather than threat of war between nations. Especially since the 9/11 terror attacks in the US, New terrorism using aircraft, high explosive, biochemical weapon, microbes spreads, thus newly international terror which has damage of the astronomical amount of money, killing and wounding human life in a huge scale, worldwide occurrence area is developing. But so far there is not absolute solution against international terror in spite of 12 particular agreements, various agreements among regions, and correspondent efforts of international society through the U.N. Due to these problems, besides the prevention of international terror, the punishment of terrorist after terror has low effectiveness and the possibility of conflict between the subjects of response against terror exists. To respond against international terror effectively, first of all, 'Comprehensive Anti-terrorism Agreement' for international society to admit and grant legal force must be adopted. For this, affirmative definition of international terror and application scope of legal structure have to be defined. Through formation of unified legal structure, essential cooperation system for response against international terror will be completed.
