국문 초록

본 논문은 미등록 이주아동의 성인기 진입에 주목하여, 이들이 각 생애 단계에서 삶의 경험과 인식이 어떻게 변화하는지 분석하고, 이들을 둘러싼 다양한 사회적, 제도적, 법적, 정치적 맥락에 의해 다음 단계의 삶이 어떻게 형성되는지 살펴보았다. 연구 결과 미등록 이주아동은 고등학교 졸업전까지는 법적·제도적으로 보호받으나 성인기 전환 이후에는 ‘불법’이라는 신분상의 문제가 이들의 열망과 기회를 제한하는 주요 요인이자 낙인으로 작용한다. 중단된 통과의례와 끝없는 리미널리티(liminality)의 상황 속에서 이들은 ‘불법’으로 대표되는 자신의 주된 지위와 낙인을 변경하고 제거하는 등 새로운 도덕적 경력을 만들어 나가기 위해 노력한다. 그러나 점차 현재 한국의 법체제 내에서 합법적 체류자격의 취득만이 불법 신분을 되돌릴 수 있는 유일한 방법이라는 사실을 인식하기 시작하면서 이들은 체류자격 시험을 통한 능력별 비자 부여와 같은 정부의 관용적이고 포용적인 합법화 정책이 시행될 수 있기를 열망하고 있다.

영문 초록

This paper focuses on the transition to adulthood of undocumented immigrant children, analyzing how their life experiences and perceptions change at each stage of their lives and how the next stage of their lives is shaped by the different social, institutional, legal, and political contexts that surround them. The results of the study show that undocumented immigrant children are legally and institutionally protected until they graduate from high school, but as they transition into adulthood, their status as “illegal” acts as an important factor and stigma that limits their aspirations and opportunities. In a situation of interrupted rites of passage and endless liminality, they strive to create a new moral career by changing and removing their master status and the stigma represented by “illegal.” However, as they gradually begin to realize that acquiring legal residency status is the only way to reverse their illegal status within the current Korean legal system, they yearn for the implementation of the government's tolerant and inclusive legalization policy.
