어업 분야 외국인 계절근로자 프로그램 운영 현황과 과제: 조례 분석을 바탕으로

국문 초록

본 연구는 어업 분야에서 운영되고 있는 외국인 계절근로자 프로그램(Foreign Seasonal Worker Program, 이하 FSWP)의 현황과 제도적 과제를 검토하기 위해 FSWP를 운용 중인 기초 지자체의 관련 조례를 분석하였다. 최근 급격한 인구 고령화와 청년층의 어촌 이탈로 인해 국내 어업은 만성적이고 심각한 인력난에 직면하고 있으며, 이에 따라 기존의 외국인 고용허가제 및 외국인선원제도만으로는 노동력 수요를 충당하기 어려운 실정이다. 이러한 맥락에서 FSWP는 어업의 계절성과 작업 특수성을 고려하여 도입된 제도로, 특히 지자체의 자율성과 책임이 강조되는 특징을 보인다. 본 연구는 자치법규정보시스템에 등록된 FSWP 관련 조례 중 어업 분야에 실질적으로 적용 가능한 25건을 분석 대상으로 삼아 조례의 구성과 특징(전담 인력 배치, 사전 이행 사항 등), 재정 지원 항목, 운영계획 수립 내용 등을 비교·검토하였다. 분석 결과, 대다수 조례는 유사한 구성을 따르며 농업 중심의 운영 방식을 답습하고 있어 어업 분야의 특수성이 충분히 반영되지 못하고 있음을 확인할 수 있었다. 또한 어업 분야에서는 해상작업을 포함한 노동 강도와 안전 이슈, 특별교육 및 인센티브 필요성 등으로 인해 지자체의 행정적·재정적 부담이 더욱 가중되고 있음에도 불구하고, 이를 보완할 제도적 장치나 중앙정부의 지원은 미흡한 실정이다. 이에 본 연구는 FSWP의 성공적 운영을 위해 다음과 같은 과제를 제시한다. 첫째, 지역 실정과 업종 특성을 반영한 조례 개정 및 세부지침 마련이 필요하며, 둘째, 복수 부서 간 협업 체계 구축과 같은 거버넌스 기반이 강화되어야 한다. 셋째, 외국인 계절근로자 풀(pool) 확보 및 입출국 절차 등 지자체의 부담이 큰 영역에 대해서는 중앙정부 또는 광역지자체의 체계적 지원이 필수적이다. 본 연구는 향후 어업 분야 FSWP의 제도적 정착과 지속가능한 운영을 위한 기초자료로 활용될 수 있을 것이다.

영문 초록

This study examines the current status and institutional challenges of the Foreign Seasonal Worker Program (FSWP) as it is implemented in the fisheries sector. To this end, it analyzes relevant ordinances enacted by local governments operating the FSWP. In recent years, Korea’s fisheries industry has faced a severe labor shortage due to rapid population aging and the outmigration of younger generations from fishing communities. As a result, existing systems such as the Employment Permit System and the Foreign Crew System are insufficient to meet the growing demand for labor. In this context, the FSWP was introduced in consideration of the seasonal and task-specific nature of fisheries work, and it has emerged as a new model for foreign labor recruitment that emphasizes the autonomy and responsibility of local governments. This study analyzes 25 ordinances registered in the Autonomous Legal Information System that are substantively applicable to the fisheries sector. It compares and reviews the structure and features of these ordinances—including the assignment of dedicated personnel and required pre-implementation procedures—as well as provisions for financial support and the formulation of operational plans. The analysis reveals that most ordinances follow similar formats and adopt agricultural-centered operational practices, thus failing to adequately reflect the specific characteristics of the fisheries sector. Moreover, despite the increased administrative and financial burdens faced by local governments due to the high labor intensity, safety concerns, and the need for specialized training and incentives associated with maritime work, institutional mechanisms and central government support remain insufficient. Based on these findings, the study proposes the following tasks for the successful operation of the FSWP in the fisheries sector. First, ordinances must be revised and detailed guidelines developed to reflect local conditions and industry-specific characteristics. Second, governance structures—such as interdepartmental collaboration systems—should be strengthened. Third, systematic support from the central or provincial governments is essential for areas that place significant burdens on local governments, such as securing foreign labor and managing immigration procedures. This study may serve as a foundational reference for the institutional establishment and sustainable operation of the FSWP in the fisheries sector moving forward.
