보육교사의 권리침해 경험과 권익보호에 관한 질적 탐구

국문 초록

아동의 권리가 강조되는 만큼 보육교사에 대한 권리보장도 필요하므로, 본 연구는 보육교사의 권리증진을 위한 정책적 기초 자료를 제공하는 데 목적이 있다. 보육교사 권리침해의 경험과 권익보호 방안에 대한 심층적 내용을 연구하기 위해 보육교사 10명을 연구 참여자로 선정하여 심층면담과 포커스 그룹면담 등의 연구 기법을 적용한 질적 탐구이다. 수집한 자료를 분석한 결과 첫째, 보육교사의 권리침해 고충으로 보육활동 간섭, 사생활 침해, 폭언, 폭행, 직장내 괴롭힘, 인권침해 등이 있었다. 둘째, 보육교사들은 이러한 권리침해에 대처하기 위한 노력으로 대화, 건의, 인내 및 순응, 그만둘 각오로 대항, 이직 등이 있었다. 셋째, 보육교사들은 그들의 권익보호를 위한 요구로 보육교사의 자격 강화, 보육교사의 권리 법제화, 동등한 보수와 전용 연금이 있었다. 특히 보육교사들은 학부모의 부정적 태도에 의한 영유아의 장애 문제가 심각해짐에 따라서, 학부모의 동의 없이 영유아의 장애검사를 청구할 수 있는 권한이 법률로 규정되기를 요구한 것은 보육현장에서 중요한 가치와 의미가 있다고 생각했다. 더불어 국가고시 제도를 도입해서 선발된 보육교사는 전문적 교육을 담당하고, 무시험 단기 교육자는 전문양육을 담당하는 것에 대한 제안은 보육의 질적 향상을 위한 정책적 문제로 대두되는 기준의 단기 교육자와 상생하는 방안이 될 수 있다는 점을 시사한다.

영문 초록

As children's rights are emphasized, it is also necessary to guarantee the rights of childcare teachers. Therefore, this study aims to provide basic policy data for promoting childcare teachers' rights. To study the in-depth contents of the experience of infringement of the rights of childcare teachers and the protection of rights, 10 childcare teachers were selected as research participants. Qualitative inquiry was conducted by applying research techniques such as in-depth interviews and focus group interviews. As a result of analyzing the collected data, first, there was interference with childcare activities, violation of privacy, abuse, assault, harassment in the workplace, and violation of human rights due to the violation of the rights of childcare teachers. Second, to cope with such rights violations, childcare teachers had conversations, made suggestions, showed patience and compliance, and demonstrated resistance to quitting, and turnover. Third, the demands of childcare teachers to protect their rights and interests included strengthening the qualifications of childcare teachers, legislating the rights of childcare teachers, equal pay, and dedicated pensions. In particular, as the problem of infants' disability became serious due to the negative attitude of the parents, the teachers thought that it was an important value and had meaning in the field of child care that the authority to request the infant's disability test without the consent of the parents was required by law. In addition, the suggestion that the childcare teachers selected by introducing the national examination system are responsible for professional education and the non-examination short-term educators are responsible for professional nurturing suggests that it can be a way to coexist with short-term educators as a policy issue for improving the quality of childcare.
