국문 초록

본 연구는 재난･안전사고 수사를 담당할 신임 재난무도 특채 교육생을 대상으로 초기 법률 인식과 수사역량의 한계를 탐색하였다. 분석 결과, 교육생들은 증거 판단, 법리적 구성요건 해석, 고의성 입증, 인과관계 판단 등 핵심적인 수사 진행 과정에서 혼란을 경험하였다. 이는 공채 합격자와 달리 체계적인 법률 지식의 부족으로 인한 특채 교육생의 특수성에서 기인한 것으로 보인다. 또한 건설 현장 경험은 풍부하나, 이를 법률적 책임 규명에 연결하는 과정에서 기술적･법률적 융합 능력 부족이 드러났다. 이러한 한계는 재난･안전사고 수사에서 객관성과 전문성을 확보하는 데 중요한 장애 요인으로 작용한다. 따라서 체계적인 사례 기반 학습(case-based learning)을 통해 법리적 해석 능력과 기술적 분석 역량을 병행할 필요가 있다. 특히, 정자교 붕괴사고와 같은 대형사고 사례를 활용한 교육은 법률적용에 대한 학습 동기를 고취시키고 수사 불안을 완화하는 효과가 있었다. 브레인스토밍 학습과 주제분석을 활용한 참여형 교육은 교육생 스스로 사고 과정을 점검하고 내적 성찰을 유도하는 유용한 방법으로 확인되었다. 향후 재난･안전사고 수사 교육에서는 법률 지식의 기초부터 심화 적용까지 단계적으로 학습할 수 있는 모듈형 커리큘럼이 필요하다. 또한, 실무 경험과 이론적 법리해석을 융합하는 훈련을 통해 전문 수사역량을 제고해야 한다. 본 연구는 특채 교육생의 초기 학습 곤란을 실증적으로 보여줌으로써, 향후 경찰 교육 과정 개편에 기초 자료를 제공한다. 궁극적으로, 사례 기반 훈련은 실체적 진실 발견과 객관적 증거 중심의 수사체계를 확립하는 데 기여할 수 있다.

영문 초록

This paper examines the initial legal awareness and investigative capacity of newly recruited disaster-special officers at the Central Police Academy. Compared with regular recruits, they exhibited significant difficulties in evaluating evidence, interpreting legal requirements, establishing intent, and determining causality. These limitations appear to stem from a lack of structured legal training, despite considerable field experience in construction. While technically competent, the trainees struggled to translate engineering expertise into legal accountability. This gap undermined objectivity and consistency in disaster and safety accident investigations. Case-based instruction, particularly the analysis of large-scale incidents such as the Jeongja Bridge collapse, proved useful in linking technical knowledge with legal reasoning and in reducing investigative anxiety. Interactive methods, including brainstorming and thematic discussion, fostered self-reflection and critical engagement. The findings underscore the need for a modular curriculum that develops legal knowledge progressively while integrating practical and theoretical perspectives. Drawing on empirical findings, this study highlights the early learning difficulties faced by specially recruited police trainees. These insights may serve as a basis for revising current legal education and police training programs. In particular, the incorporation of case-based training holds promise for fostering an investigative approach rooted in objective evidence and oriented toward achieving substantive justice.
