국문 초록

본 연구는 경찰관의 현장 대응형 집행 활동과 경찰법상 구체적 위험과의 관련성 등을 고찰하고 현행 경찰 관련 법에서 경찰관의 현장 대응형 집행 활동 권한의 법적 특징을 살펴본다. 이와 같은 연구목적을 달성하기 위하여 문헌연구를 통해 우리나라와 일본 및 독일의 단행본 및 논문, 판례등을 검토한다. 경찰관의 현장 대응형 집행 활동은 경찰관이 현장에서 확인하고 얻은 구체적 위험에 대하여 그 배제를 직접적인 목적으로 행해지는 권력적 조치라는 점에서 다음과 같은 법적 특징을 인정할 수 있다. 먼저 경찰관의 현장 대응형 집행활동은 구체적 위험을 제거하기 위한 조치권한이므로 구체적 위험이 해소된 시점에서 동 권한의 행사는 즉시 정지되어야 하며, 그 계속은 형사소송법 등의 다른 개별 법령에 특별한 규정이 없는 한 정당화되지 않는다. 다음으로 경찰관의 현장 대응형 집행 활동은 그 조치가 취해진 시점을 기준으로 합리적이고 정당한 내용의 것이라고 판단되는한, 실제 구체적 위험이 존재하지 않았던 것으로 사후에 판명되었다 하더라도 당연히 위법하다고평가되는 것은 아니다. 결국 공공의 안전과 질서를 유지하고 장래에 발생할 우려가 있는 위험의 방제를 그 목적으로 하는 경찰관의 현장 대응형 집행활동은 국민의 기본권을 침해할 우려를 내포하고있어 경찰 목적 달성과 국민의 기본권 보장이라는 이 두 가지 명제를 어떻게 적절히 조화시키는가가 앞으로의 우리 경찰법학의 중요한 과제 중 하나이다.

영문 초록

This study examines the relationship between police officers'field-response execution activities and specific risks under the police law, and examines thelegal characteristics of police officers' field-response execution activities in the current police research method that reviews books, papers, and precedents in Korea, Japan, and Germany onthis topic. The following legal characteristics can be recognized in that the police officer'son-site response execution activities are power measures performed for the direct purpose ofexcluding specific risks identified and obtained by the police officer at the scene. First, sincepolice officers' field-response enforcement activities are the authority to take action toeliminate specific risks, the exercise of this authority should be suspended immediately whenthe specific risk is resolved, and its continuation is not justified unless there are specialprovisions in other individual laws such as the Criminal Procedure Act. Next, as long as thepolice officer's field-response execution activities are judged to be reasonable and legitimatebased on the time the action was taken, even if the actual specific risk was found to have notexisted after the fact, it is not necessarily considered illegal. In the end, police officers' on-siteenforcement activities aimed at maintaining public safety and order and controlling risks inthe future are feared to violate the basic rights of the people, so how to properly harmonizethese two propositions, achieving police objectives and guaranteeing the basic rights of thepeople, is one of the important tasks of our police law.
