국문 초록

디지털 전환이 가속화되는 사회에서 디지털 시민성은 단순한 기술 접근을 넘어, 참여와 권리의 문제로 확장되고 있다. 본 연구는 장애인의 디지털 시민성을 보장하기 위한 법 제도적 기반을 평가하고자, 2026년 시행 예정인 「디지털포용법」을 중심으로 그 법제적 진전과 한계를 분석하였다. 이를 위해 디지털 시민성의 세 가지 핵심 영역(존재, 웰빙, 권리)과 네 주체(이용자, 서비스 제공자, 타 이용자 및 커뮤니티, 정책 및 규제기관)를 중심으로 개념적 분석틀을 구성하였다. 분석 결과, 「디지털포용법」은 접근성 강화, 맞춤형 역량 지원, 공공서비스 개선 등에서 진전을 보였으나, 민간 책임 규정의 미비, 권리 중심 시민교육의 부족, 권리구제 장치의 부재 등 여전히 보완이 필요한 영역이 존재하였다. 본 연구는 향후 디지털 공간에서 장애인의 실질적 시민권 보장을 위한 정책 및 법 제도의 발전 방향을 제시한다.

영문 초록

As digital transformation accelerates, digital citizenship has evolved beyond mere access to technology, encompassing broader issues of participation and rights. This study evaluates the legal and institutional foundations for ensuring digital citizenship for persons with disabilities by analyzing the improvements and limitations of the Digital Inclusion Act, which is scheduled to take effect in 2026. A conceptual analytical framework was constructed, focusing on three core dimensions of digital citizenship (Being Online, Well-being Online, Rights Online) and four types of responsible actors (users, service providers, other users/ communities, and policy/regulatory institutions). The analysis revealed that the Act has progressed in areas such as enhancing accessibility, providing tailored capacity-building, and improving public services. However, it also identified areas requiring further development, including insufficient provisions for private sector responsibility, lack of rights-based digital citizenship education, and ineffective remedies. This study suggests directions advancing policies and legal frameworks to ensure substantive digital rights for persons with disabilities in the digital environment.
