건설재해사고 수사체계 개선 연구: 수사경찰과 현장관리자의 인식 차이를 중심으로

국문 초록

1981년 ｢산업안전보건법｣ 제정과 2022년 ｢중대재해처벌법｣ 시행 이후 건설재해 사고 건수는 감소하고 있으나, 여전히 문제가 완전히 해소되었다고 보기는 어렵다. 건설현장 사고 수사는 경영책임자의 관리의무 위반과 사고 고의성 입증의 어려움으로 장기화되며, 경찰과 현장관리자가 각각 수사 권한을 행사하는 이원적 구조와 인식 차이도 장애요인으로 작용한다. 그러나 이에 대한 국내 연구는 부족한 실정이다. 이 연구는 수사경찰과 현장관리자 간 인식 차이가 건설재해 사고 원인의 직접ㆍ간접 판단에 미치는 영향을 분석하였다. 또한 건설현장의 제도적 관행과 수사 과정의 문제를 파악하기 위해 5년 이상 경력을 가진 전문가를 대상으로 심층면접과 설문조사를 실시하였다. 이를 통해 건설재해 사고 원인을 8개 영역 30개 세부 항목으로 분류하고 AHP 분석을 수행하였다. 분석 결과, 경찰과 현장관리자 간 인식 격차가 확인되었으며, 이를 해소해 건설재해사고 수사의 객관성과 신뢰성을 높이는 방안을 제시하였다. 이 연구는 향후 건설재해 안전대책 수립과 경찰 수사 및 안전정책의 기초자료로 활용될 수 있다는 점에서 의의를 갖는다.

영문 초록

Since the enactment of the Occupational Safety and Health Act in 1981 and the enforcement of the Serious Accident Punishment Act in 2022, the number of construction accidents has decreased, but it is still difficult to say that the problem has been completely resolved. Investigation of construction site accidents is prolonged due to violations of management obligations of management managers and difficulties in proving accident intentionality, and differences in dual structures and perceptions in which police and field managers exercise their investigation authority, respectively, also act as obstacles. However, domestic research on this is insufficient. This study analyzed the effect of the difference in perception between the investigative police and the field manager on the direct and indirect judgment of the cause of the construction accident. In addition, in-depth interviews and surveys were conducted with experts with more than 5 years of experience in order to understand the problems of the institutional practices and investigation process of construction sites. Through this, the causes of construction accidents were classified into 30 sub-items in 8 areas and AHP analysis was performed. As a result of the analysis, the gap in perception between the police and the field manager was confirmed, and a plan to increase the objectivity and reliability of the investigation of construction accidents was suggested by solving this. This study is significant in that it can be used as basic data for the establishment of safety measures for construction accidents in the future and police investigation and safety policies.
