한국형 민간조사 제도 도입을 위한 학술적 고찰

국문 초록

현대사회는 정보 비대칭성과 사적 분쟁의 증가로 인해 공공수사기관만으로는 모든 정보 수요에 효과적으로 대응하기 어렵다. 이에 따라 민간영역에서의 합법적이고 전문적인 조사활동에 대한 수요가 꾸준히 확대되고 있으나, 한국은 아직 민간조사제도에 대한 법적 근거가 마련되지 않아 무자격 활동, 사생활 침해, 조사결과의 신뢰성 저하 등 여러 문제가 발생하고 있다. 본 연구는 이러한 문제의식을 토대로 한국형 민간조사 제도의 도입 필요성과 설계 방향을 학술적으로 고찰하였다. 연구방법으로는 문헌연구와 법령 분석을 병행하고, 미국ㆍ일본ㆍ독일 등 주요 국가의 제도운영 사례를 비교분석하여 한국적 맥락에서 적용 가능한 요소를 도출하였다. 특히, 개인정보보호법, 형법, 변호사법 등 현행 법체계와의 충돌 가능성을 검토하고, 활동범위 설정, 자격기준, 감독기구설계, 윤리강령 제정 등 제도설계의 핵심요소를 단계별 도입전략과 연계해 제시하였다. 연구 결과, 민간조사 제도는 사적 정보조사의 투명성과 합법성을 보장하는 제도적 장치로서 시민의 정보접근권을 확대하고, 공공수사기관의 한계를 보완하는 사회적 기능을 수행할 수 있음을 확인하였다. 또한 해외사례와의 비교를 통해 한국형 제도의 도입은 등록제 기반의 관리, 자격ㆍ윤리 기준 강화, 민사소송 증거 활용성 확대라는 세 가지 축을 중심으로 추진할 필요가 있음을 제안하였다. 다만 본 연구는 문헌분석과 해외사례 비교를 중심으로 하였기에, 실제 제도운영의 실증자료와 시민 인식조사, 직역단체와의 협의방안은 후속연구에서 보완되어야 한다.

영문 초록

In contemporary society, the asymmetry of information and the rise of private disputes make it difficult for public investigative agencies alone to effectively meet all demands for information. Accordingly, there has been a steady increase in the demand for legitimate and professional investigative activities within the private sector. However, in Korea, the absence of a legal basis for a private investigation system has resulted in problems such as unlicensed activities, infringements of privacy, and diminished reliability of investigative outcomes. This study examines the necessity of introducing and the design directions for a Korean-style private investigation system from an academic perspective. The research methods combine literature review and legal analysis, while also conducting comparative analysis of institutional practices in major countries including the United States, Japan, and Germany, in order to derive elements applicable to the Korean context. In particular, the study reviews potential conflicts with the current legal framework—such as the Personal Information Protection Act, the Criminal Act, and the Attorney-at-Law Act—and presents core elements of system design, including defining the scope of activities, establishing qualification criteria, creating supervisory institutions, and enacting ethical codes, in connection with a phased introduction strategy. The findings confirm that a private investigation system can serve as an institutional mechanism to ensure transparency and legality in private investigative activities, thereby expanding citizens’ right to access information and supplementing the limitations of public investigative agencies. Furthermore, through a comparison with foreign cases, this study suggests that the introduction of a Korean-style system should be pursued around three pillars: management based on a registration system, reinforcement of qualification and ethical standards, and expansion of admissibility of investigative findings in civil litigation. Nevertheless, as this study relies primarily on literature analysis and cross- national comparisons, it lacks empirical data on actual institutional operations, surveys of public perception, and consultation strategies with professional associations. These limitations should be addressed in future research.
