제주자치경찰단 특별사법경찰제의 실태분석과 미래지향적 제언

국문 초록

우리나라 특별사법경찰제는 1956년 사법경찰관리의 직무를 수행할 자와 그 직무범위에 관한 법률(약칭: 사법경찰직무법)을 제정하면서 시작되었다. 2023년 12월 말 기준 35개 중앙행정기관과 지방자치단체 소속 총 20,600명의 특사경이 검찰청 보도자료에 나와 있다. 본 논문은 제주자치경찰단 특별사법경찰제의 실태분석과 미래지향적 제언을 내놓았다. 대부분의 특별사법경찰기관들은 기관장이 자체 공무원 중 특사경을 추천하면 이를 관할 검찰청 검사장이 지명한다. 그러나 제주자치경찰단 특사경(이하 특사경)은 제주특별법상 법정 특사경으로 따로 검찰의 지명을 필요로 하지 않으며 주로 산림ㆍ환경ㆍ관광 분야 등 지역사회의 안전과 밀접하게 관련된 분야에서 활동하고 있다. 2006년 시행된 제주자치경찰단 특별사법경찰제의 수사직무 범위는 2025년 초 기준 19개 분야 93개 법률로 대폭 확대되었다. 그동안 제주특사경은 많은 성과도 도출해 냈음에도 불구하고 다음의 4가지 법률 분야는 아직 까지 부여받 못한 관계로 새로운 신종범죄들을 단속하는데 어려움이 많은 실정이다. 따라서 이 문제를 해결하기 위해서는 사법경찰직무법 제6조 제18호의 나목인 ｢보건범죄 단속에 관한 특별조치법｣ 중 의료(醫療)에 관한 범죄’ 문구의 추가와 제10조 자치경찰공무원의 직무범위에 ｢사법경찰직무법｣ 제6조제18의2호(감염병예방법), 제6조제36호(여객자동차법), 제6조제50호(부동산 3법)를 추가하는 법개정이 시급한 실정이다. 또한 본 논문에서는 제주자치경찰단 특별사법경찰제의 미래지향적 제언으로 제주자치경찰 특사경 수사 직무범위의 확대 등 7가지를 내놓았다.

영문 초록

South Korea's Special Judicial Police System began in 1956 with the enactment of the Act on the Duties of Judicial Police Officers and Their Scope of Duties(abbreviated as the Judicial Police Duties Act). As of the end of December 2023, a total of 20,600 special judicial police officers were listed in press releases from 35 central administrative agencies and local governments. This paper analyzes the current status of the Jeju Autonomous Police Corps' Special Judicial Police System and offers future-oriented recommendations. Most special judicial police agencies have their heads nominate special judicial police officers from among their own civil servants, who are then appointed by the chief prosecutor of the competent prosecutor's office. However, the Jeju Autonomous Police Corps' Special Judicial Police Officers (hereinafter referred to as “Special Judicial Police Officers”) are statutory special judicial police officers under the Jeju Special Act, and do not require separate appointment by the prosecution. They primarily work in areas closely related to community safety, such as forestry, the environment, and tourism. The scope of investigative duties under the Jeju Autonomous Police Corps' Special Judicial Police System, implemented in 2006, has significantly expanded to 19 fields and 93 laws as of early 2025. Although the Jeju Special Judicial Police have achieved many achievements, they have yet to be granted the following four legal areas, making it difficult to crack down on new and emerging crimes. Therefore, to address this issue, urgent legal revisions are needed to include the addition of the phrase “crimes related to medical treatment” to the “Special Measures Act on the Crackdown on Health Crimes”(Article 6, Paragraph 18, Subparagraph B) of the Judicial Police Duties Act. Furthermore, Article 6, Paragraph 18-2(Infectious Disease Prevention Act), Article 6, Paragraph 36 (Passenger Vehicle Act), and Article 6, Paragraph 50(Three Real Estate Acts) of the Judicial Police Duties Act are also needed to address the scope of duties of autonomous police officers in Article 10. Furthermore, this paper presents seven future-oriented proposals for the Jeju Autonomous Police Corps' Special Judicial Police System, including expanding the scope of investigative duties of Jeju Autonomous Police Special Judicial Police officers.
