중국정부의 특수교육 법제화 과정에 관한 소고

국문 초록

본 논문은 중국 특수교육 법제화 과정을 1997년 ‘의법치국(依法治國)’ 선언을 중심으로 하여 살펴보았다. ‘의법치국’이란 말 그대로 법으로써 나라를 통치한다는 의미이지만, 당대의 중국공산당은 이를 자신의 통치지위를 항구적으로 보장받기 위한 장치로 삼고 있다. 당대 중국의 법률 법규의 제정 및 개정은 모두 이 선언에 근거하여 진행되는바, 특수교육 법제화 또한 의법치국의 틀을 통해 이해되어야 한다. 본 논문은「의무교육법」,「장애인보장법(Law on the Protection of the Disabled)」그리고 중국 내 특수교육 관련 최고 권위의 법규라 할 수 있는「장애인교육조례( regulations on the education of the disabled)」를 중심으로 ‘의법치국’ 선언 전과 선언 후의 개정 내용 등을 살펴보았다. ‘의법치국’ 선언 이후 특수교육 법제화 과정에서 나타난 가장 큰 변화는 당위적이며 선언적이었던 특수교육 법제의 성격이 점차 실천적인 성격으로 바뀌면서 양적팽창보다는 실효성을 고려한 내실화에 중점을 두었다는 점이다. 여기에는 통합교육으로의 전환도 포함된다. 2013년 현재 상정되어 있는「장애인교육조례」(수정안)는 이러한 시대적 변화를 반영하여 있으며, 나아가 중국「특수교육법」제정의 초석이 될 것으로 보인다. 법은 시대와 환경에 따라 변화되며, 따라서 그 나라의 시대상을 반영한다는 측면에서 당대 중국정부의 특수교육 법제화 과정에 대한 고찰은 중국 특수교육을 이해하는 데에 도움이 될 것으로 기대한다.

영문 초록

The purpose of this study was to examine the Chinese declaration of YI-FA-ZHI-GUO in 1997 in an effort to shed light on the legislation of special education in China. YI-FA-ZHI-GUO means to govern a country according to law, as the word itself shows what it means. Since this declaration is the basis for the legislation and revision of every law and regulation of China, the legalization of special education also should be understood in conjunction with YI-FA-ZHI-GUO. In this study, the Compulsory Education Act and the Law on the Protection of the Disabled were analyzed to find out what was revised in the two laws after the declaration of YI-FA-ZHI-GUO, and the Regulations on the Education of the Disabled that could be said as the supreme law of China related to special education was analyzed as well. The greatest change in the legalization of special education after the declaration of YI-FA-ZHI-GUO was that the special education laws were initially normative and declarative but gradually became practical. Namely, the Chinese government tried to enact more substantial and effective laws instead of merely making lots of laws, and the switch from special education to inclusive education has also been legislated. The amendment of the Regulations on Education of the Disabled has been laid in 2013 in line with such a change, and that is expected to lay the foundation for the legalization of special education of China. Basically, law varies with age and environments, and a careful consideration of the legalization of special education by the Chinese government is expected to make it easier to have a perfect understanding of Chinese special education in that law represents the phases of the times.
