미국 장애인 교육법(IDEA)상 장애 영유아 교육서비스에 대한 고찰

국문 초록

본 연구는 미국의 ‘장애인 교육법’(IDEA)상 장애 영유아의 권리보호에 대한 내용을 고찰하고, 그 시사점을 찾는데 중점을 두었다. 이를 위해 한국의 ‘장애인 등에 대한 특수교육법’을 비교를 위한 검토의 대상으로 삼았다. 미국 IDEA는 이 법 내에 별도의 독립된 부분(Part C)을 마련하여 장애 영유아의 권리를 보호하고 있다. 특히 만 3세 이하의 장애 영유아에 대하여는 국가, 부모 및 전문가가 협의하여 개발한 종합적인 돌봄(total care)서비스를 제공하고 있다. 이 서비스는 조기중재서비스(EIS)라 불리우며, 장애아의 부모가 참여하는 개별화된 가족서비스계획(IFSP)팀에 의해 개발된다. 한편, 우리나라에서는 만 3세미만의 장애 영유아에 대한 특수교육서비스는 부모의 필요에 따른 선택적 신청제도를 채택하여, 장애 영유아에 대한 지원이 정부에 의한 적극적 지원보다는 부모의 재정능력에 의존하고 있는 실정이다. 향후 만 3세미만의 장애 영유아에 대한 실질적인 권리가 보장될 수 있도록 법령제도 개선이 필요하다.

영문 초록

The purpose of this study was to explore the educational services for infants and toddlers with disabilities in IDEA and to suggest the implications through comparing those with the similar services in the Special Education Act of Disabilities (SEAD) in South Korea. IDEA is the federal law of the U.S. that requires schools to provide special education and related services for the qualified children with disabilities. Part C of the IDEA, which was mainly researched, governed policies for infants and toddlers under age 3. The results were that the U.S government was more delicately providing early intervention services designed to meet the developmental needs of a particular infant or toddler. The individualized family service plan team in states developed early intervention services by a family-directed assessment of the resources, priorities, and concerns of the family. Meanwhile it was found that the Korean government was not providing appropriately free special education and related services for the infants and toddlers below age 3. This was partly blamed on the fact that the Korean Act (SEAD) addressed the voluntary application system of parents for free special education below age 3, meaning it served only those that apply. In conclusion, it was suggested that the Korean government expanded more free special education and related services for the infants and toddlers below age 3. The revisions of the Korean Act (SEAD) were recommended.
