미국과 독일의 장애인 직업 재활 제도 측면에서 본 공민권 모델의 한계와 대안

국문 초록

본 연구는 미국이 공민권 모델에 장애 정책의 초점을 맞추면서, 장애인 직업 재활과 같은 실질적 고용 지원 체계의 개혁과 확대에는 상대적으로 소극적이었다는 문제의식에서 출발한다. 공민권 모델은 차별금지와 기회 평등 보장에는 일정한 성과를 거두었으나, 장애인 고용을 저해하는 구조적 장벽을 해소하는 데에는 한계를 보이며 제도적 취약성을 드러냈다. 미국 장애인 직업 재활 시스템의 제약은 이러한 공민권 모델의 한계를 방증하는 사례라고 할 수 있다. 이에 본 연구는 공민권 모델의 이러한 한계를 분명히 하고, 이를 보완할 수 있는 정책적 대안을 모색하고자, 역사적 제도주의의 분석틀에 따라 미국과 독일의 장애인 직업 재활 제도를 역사적 배경, 행정조직체계, 사회경제적 이념, 법적 토대의 네 가지 측면에서 비교·분석하였다. 미국의 장애인 직업 재활 시스템은 성과 기반 운영 방식, 예산 부족, 복지 서비스 간 연계 부족 등의 문제로 인해 고용 확대에 뚜렷한 제약을 보여 왔다. 반면, 독일은 차별금지 원칙과 권리 기반 접근 방식을 수용하여, 기존의 재활 중심 체계를 장애인의 사회 참여와 통합을 촉진하는 방향으로 재정비하였다. 본 연구는 양국의 제도 비교를 통해, 장애인의 실질적 사회 참여 및 통합을 실현하기 위해 포괄적인 고용 지원 체계 구축, 법적·제도적 기반 확립, 이에 상응하는 재정적 투입 등 국가 차원의 적극적인 정책 개입이 필수적임을 보여준다.

영문 초록

This study begins with the concern that U.S. disability policy, centered on the civil rights model, has remained relatively passive in reforming and expanding practical employment support systems such as vocational rehabilitation. While the civil rights model has achieved certain outcomes in banning discrimination and ensuring equal opportunity, it reveals institutional vulnerabilities in addressing structural barriers to employment for persons with disabilities. The limitations of the U.S. vocational rehabilitation system exemplify these shortcomings. To clarify such limitations and explore policy alternatives, this study conducts a comparative analysis of U.S. and German vocational rehabilitation systems through the lens of historical institutionalism, focusing on four dimensions: historical background, administrative structure, socioeconomic ideology, and legal foundations. The U.S. system faces clear constraints in employment expansion due to performance-based operations, budget shortages, and weak inter-service coordination. In contrast, Germany has integrated non-discrimination principles with a rights-based approach, restructuring its rehabilitation-centered model to promote social participation and integration. This comparison shows that ensuring meaningful participation and integration of persons with disabilities requires comprehensive employment support, institutional and legal foundations, and sufficient national-level policy intervention.
