지방의원의 행동강령 현황과 개선 방안 : 합리적 선택이론을 중심으로

국문 초록

본 연구는 지방의원의 청렴성 강화를 위하여 지방의원 행동강령의 현황을 고찰하고 합리적 선택이론에 근거한 순응-규제형 중심의 개선방안을 제시하고자 하였다. 첫째, 지방자치법을 개정하여 지방의원만의 윤리특별위원회 구성을 외부위원이 반드시 포함되게 구성하여 윤리강령 위반에 대한 징계의 공정성을 확보해야 한다. 둘째, 지방자치법상 징계대상 지방의원에 있어 징계요구를 받으면 윤리특별위원회에 회부한다고 규정하고 있는 부분을 개정하여 누구든지(시민, 단체, 의원, 윤리특별위원회 스스로) 윤리특별위원회에 징계 요청 진정서를 제출할 수 있도록 해야 한다. 셋째, 4가지로 구분하고 있는 징계내용을 교육, 견책, 직무정지, 자격정지, 벌금 등 상세한 징계종류를 규정하여야 한다. 넷째, 지방의원의 겸직, 상임위원회 정보, 징계현황 등의 정보를 지방의회 홈페이지 공개하는 것을 의무화하여 다른 지방의회에서 유사한 징계상황이 발생하는 경우에 참고가 될 수 있도록 하여야 한다.

영문 초록

In order to strengthen the integrity of local councilors, this study examined the current status of the local councilor's code of conduct and suggested a compliance-regulatory-oriented improvement plan based on the rational choice theory. The Local Autonomy Act should be revised to ensure fairness in disciplinary action for violations of the Code of Ethics by revising the Local Autonomy Act to include external members. The Local Autonomy Act shall revise the part that stipulates that local councilors subject to disciplinary action will be referred to the Special Committee on Ethics if they receive a request for disciplinary action so that anyone (citizens, organizations, lawmakers, and special committees on ethics themselves) can submit a petition for disciplinary action to the Special Committee on Ethics. The details of disciplinary action, which are divided into four categories, such as education, reprimand, suspension of duties, suspension of qualification, and fines, should be specified. It shall be mandatory to disclose information such as concurrent positions, information on standing committees, and disciplinary status of local council members on the website so that other local councils can refer to similar disciplinary situations.
