범죄인가 범죄화인가: 반(反)이민 프레임의 정치성과 한국의 과제

국문 초록

이 연구는 ‘외국인 범죄’를 둘러싼 담론이 어떠한 정치·미디어적 프레이밍을 통해 형성·확산되며, 그 과정에서 ‘범죄 그 자체’와 ‘범죄화’가 어떻게 뒤엉키는지를 비교정책 관점에서 분석한다. 특히 트럼프 행정부 시기 미국의 반(反)이민 레토릭과 이민의 형사화(crimmigration), 독일의 2015-2016년 난민 위기 이후 ‘인도주의와 질서’라는 이중 기조, 그리고 브렉시트 이후 영국의 르완다 이송 구상과 강경한 국경통제 법제를 사례로 검토한다. 선행연구·정책문서·공식통계를 종합한 결과, (1) 실제 범죄통계와 대중 인식 사이의 괴리, (2) 공포정치와 미디어 프레이밍이 낙인과 도덕적 공황을 증폭시키며 형사·이민정책을 경도시키는 메커니즘, (3) 강경 단속이 신고·협조 의지를 위축시켜 치안의 사각지대를 확대하는 역효과가 확인되었다. 한국에 대해서는 증거기반성, 적법절차·인권규범, 사회통합정책과의 정합성을 동시 점검하는 다층 거버넌스 설계, 국적·인종 프레임을 자극하는 선정적 보도 관행의 개선을 정책적 함의로 제시한다. 이를 통해 본 연구는 ‘범죄인가, 범죄화인가’라는 질문에 대해 배타적 담론을 넘어선 통합적 치안·이민정책의 방향을 제안한다.

영문 초록

This study examines how “foreigner crime” is constructed and amplified through political and media framing, disentangling substantive crime from its criminalization in a comparative policy perspective. Focusing on three cases—the Trump administration’s anti-immigration rhetoric and the convergence of criminal and immigration law (crimmigration) in the United States, Germany’s dual track of “humanity and order” following the 2015-2016 refugee crisis, and the United Kingdom’s post-Brexit hardline border control including the Rwanda removal scheme—we synthesize prior research, policy texts, and official statistics. Findings indicate: (1) a persistent gap between crime statistics and public perceptions; (2) a mechanism by which fear politics and media framing intensify stigma and moral panics, steering criminal and immigration policies; and (3) unintended consequences whereby aggressive enforcement chills reporting and cooperation, expanding blind spots in public safety. For Korea, we propose multi-level governance that simultaneously checks evidence-based design, due process and rights standards, and alignment with integration policy; couples targeted investigations with community-based integration programs; and reforms sensational reporting that racializes or nationalizes crime. The paper offers a cross-validated framework linking statistics, institutions, and discourse, and outlines an integrated direction for security and immigration policy beyond exclusionary narratives.
