국문 초록

지난 2020년 12월에「경찰법」이「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」로 전부 개정되고, 이에 따라 2021년 7월 전국 시·도경찰청에 자치경찰제도가 도입되었다. 1948년 대한민국 정부수립 이후, 처음으로 전국에 자치경찰제도가 시행되었다는 점에서 적지 않은 역사적 의의가 있다고 본다. 자치경찰제도를 도입한 목적은 경찰의 정치적 중립성을 확보하고, 민주적으로 운영함으로써 국민의 자유와 권리를 보다 보호하고자 하는 것이다. 그런데, 자치경찰제도는 이의 역사적 의의와 목적에도 불구하고 적지 않은 한계를 안고 있다. 자치경찰제도의 도입과정에서부터 정치적 역학관계 특히, 집권여당의 이해관계가 적지 않게 반영되었기 때문이다. 자치경찰제도는 종전과 같이 국가경찰의 조직·인사·예산구조를 거의 그대로 유지한 채, 국가경찰사무의 일부를 자치경찰사무로 이관하고, 이를 심의·의결하는 시·도자치경찰위원회를 설치하는 수준이다. 더욱이 자치경찰사무를 담당하기 위해 설치된 시·도자치경찰위원회의 위원회 구성과 위원 임명 등에 있어서 정치적 중립성과 전문성, 그리고 지역적 균형성 등의 문제가 적지 않게 제기되고 있다. 또자치경찰위원회의 시· 도경찰청장에 대한 지휘감독권의 행사와 시· 도경찰청장에 대한 인사권 역시 그 실효성을 담보하기가 어려운 상황이다. 이러한 점에서 이번에 도입된 자치경찰제도는 ‘실질적 자치경찰’이 아닌 ‘형식적 자치경찰’이라는 태생적 한계를 안고 있음은 부인하기 어렵다. 자치경찰제도가 실질적으로 정착되기 위해서는 중· 장기적관점에서 이에 대한 제도적 재검토가 필요하다고 본다. 그 구체적 내용으로는 독립된 자치경찰관청의 설치, 자치경찰공무원의 임용, 자치경찰예산의 독립적 운용 등이 이루어져야 한다고 본다. 그리고 중앙정부 차원에서 자치경찰사무를 관리하는 시·도자치경찰위원회의 정치적 중립성과 지역적 균형성 확보를 위한 체계적인 관리가 이루어져야 한다고 본다.

영문 초록

In December 2020, the Police Ac t was amended as the National Police and Au t o n o m o u s Police Organization and Operation Ac t , and in July 2021, the autonomous police system was introduced to the metropolitan police Agencies. Since the establishment of the government of the Republic of Ko r e a in 1948, it has been operated as a national police system. For the first time, the autonomous police system was introduced to the metropolitan municipali ti es. The purpose of introducing such a autonomous police system is to secure the political neutrality of the police and to protect the freedom and rights of the people by operating democratically. However, it is true that the autonomous police system introduced this time has a fundamental limitations despite its historical significance and purpose. This is because political dynamics, especially the interests of the ruling party, were reflected in the introduction of the autonomous police system. Therefore, it was introduced to the level of establishing a metropolitan police committee that transfers part of the national police affairs to the autonomous police affairs and deliberates and resolves it whi le maintaining the existing organization, personnel and budget structure of the national police. Moreover, there are a lot of problems such as political neutrality, professionalism, and regional balance in the composition and appointment of committee members of the metropoli tan autonomous police committee established to take charge of the autonomous police affairs. In addition, it is difficult to guarantee the effectiveness of the committee's exercise of command and supervision over the city and provincial police chief and the personnel rights to the city and provincial police chief. In this regard, the autonomous police system introduced this time is not an unemployed autonomous police officer. In order for the autonomous police system to be settled in practice, it is necessary to review the purpose and system of introduction from the mid & long-term perspective. The specific contents of this study are to establish an independent autonomous police agency and to appoint a autonomous police officer. An d it is necessary to systematically manage the political neutrality and regional balance of the autonomous police committee that manages the autonomous police affairs at the central government level.
