독일의 집회시위 참가인원 추산 및 공개에 관한 경찰실무에 대한 고찰

국문 초록

이 연구는 집회시위에 참가한 인원을 객관적으로 산정하는 것이 가능한가에 대한 독일의 사례를 살펴보고 그것이 우리나라에 주는 시사점이 무엇인지를 고찰하였다. 먼저, 독일에서도 우리나라와 마찬가지로 집회시위 참가인원의 규모를 두고 경찰과 집회시위의 주최측 간에 논란이 있었다. 집회시위에 얼마나 참가했는가는 주최 측에게는 집회의 ‘결과’ 또는 ‘성패’의 문제인 반면, 경찰에게는 경찰력을 운용하는 데 고려해야 할 변수가 되는 ‘현재 상황’으로 보기 때문이다. 둘째, 독일 경찰은 집회시위의 참가인원이 최대치가 된 시점에 참가인원을 집계한다는 점이다. 집회시위 대응에 필요한 경찰력은 최악의 상황, 즉 참가인원이 최대인 시점을 기준으로 결정되어야 하기 때문이다. 셋째, 그렇지만 어떠한 방식으로 집회시위 참가인원을 산정하는지에 대해서는 하나의 통일된 방식이 존재하지는 않았다. 대체로 촬영을 통한 집계방식이 최근 자주 활용되었다. 마지막으로 독일의 경찰도 참가인원에 대한 집계결과를 공식적으로 발표하는 경우는 드물었다. 다만, 언론 또는 의회 등에서 집회시위 참가인원의 규모에 대해 문의하게 되는 경우, 경찰은 원칙적으로 알권리 차원에서 집계결과를 제공하고 있었다.

영문 초록

This study is aim to resolve controversy between the organizer and the police on count methods for the assembly and demonstration participants in focusing on the case of Gemany. The results of this study are as follows. First, there is also a controversy between the police and organizers of demonstrations on count methods in Germany as in Korea. How many participants participated in the demonstration is a matter of “result” or “success or failure” for the organizer. It is for the police because of the 'present situation' which is a variable to be considered in the operation of the police force. Second, the German police count the number of participants in the demonstration when the maximum number of participants. Because police have to consider the worst situation. Third, however, there was no uniform way of calculating the number of participants in the rallies. Generally, the method of counting through photographing has been used frequently recently. Finally, it is not uncommon for the German police to officially announce the results of the counts of the participants. However, when inquiring about the size of the people who participated in the demonstration in the media or the parliament, the police provides the result of the counting in terms of the right to know in principle.
