성폭력 범죄 피해자의 2차 피해 유발요인 분석을 통한 예방책 모색 : 성폭력 범죄 피해자와 수사 담당자에 대한질적 면담을 중심으로

국문 초록

성폭력(sexual violence) 범죄는 심리적·물리적·법적으로 성과 관련되어 이성에게 위해를 가하는 폭력적 행위와 상대방의 의사에 반하는 성적인 접촉을 통틀어 지칭한다. 그러나 성폭력 범죄는 암수범죄의 비율이 매우 높을 뿐 아니라 피해 회복이 다른 범죄에 비해 어려운 성격이 있다. 또한 성폭력 범죄 피해는 범죄로 인한 1차적 피해에 그치지 않으며, 수사 과정에서 형사사법기관에 의해 다양한 2차 피해에 노출되고 있다. 따라서 이 연구에서는 위와 같이 2차 피해의 유발 단계로 지목되는 수사기관에 종사하는 자들에 대한 질적 연구를 통해 2차 피해에 대한 피해자들의 인식과 수사 담당자들의 인식 차이를 분석하고 이를 통해 수사기관에서의 2차 피해 감소방안을 모색하였다. 연구결과, 성폭력 범죄의 2차 피해의 원인에 대해 성폭력 범죄 피해자들과 수사 담당자들의 인식태도는 상당한 차이를 보인 것으로 나타났다. 성폭력 범죄 피해자들은 수사 절차·수사 담당자·피해자 보호 및 지원체계·언론 태도 등 매우 다양한 부분에서 2차 피해가 발생하고 있다고 답했다. 반면 수사 담당자들은 2차 피해는 현재의 법령 및 제도 상 발생할 수 없고 피해자들이 느끼는 감정들은 수사의 구조상 나타날 수 밖에 없다는 태도를 보였으며, 언론에 대해서도 수사기관의 직접적인 책임은 없다는 인식을 가지고 있는 것으로 나타났다. 다만, 국선변호인의 실효성·전문성 및 교육 부족 등에 대해서는 피해자들과 수사 담당자들이 비슷한 시각을 보이는 것을 알 수 있었다. 이러한 결과는 성폭력 범죄 피해자들은 2차 피해에 대해 상당히 민감하게 반응하고 있는 반면, 수사 담당자들은 여전히 소극적 태도를 가진 것을 여실히 보여준다고 할 수 있다. 위와 같은 문제를 개선하기 위한 대안으로 ‘법령의 개정과 제도·교육의 확대’를 제시하고자 한다. 먼저 최근 개정된 「경찰법」 과 「경찰관직무집행법」의 ‘범죄피해자 보호’ 조항의 하위 법령에 피해자 보호와 지원을 위한 구체적인 개정이 조속히 시행되어야 한다. 또한 피해자의 정보접근권의 강화를 위한 ‘피해자 권리고지 제도’를 피해자의 눈높이에 맞도록 개선하고, ‘피해자보호팀’ 등 심리지원을 위한 조직 및 인력의 확충이 이뤄져야 한다. 아울러 사건 초기부터 피해자 보호를 위해 국선변호인의 선임시기를 경찰 수사 이전으로 조정하고, 피해자 여비 지급 범위를 확대하여 피해자인 고소인도 여비를 지급받을 수 있도록 해야 할 것이다. 마지막으로 수사 담당자 인식 개선을 위해 피해자 보호·지원을 주제로 하는 소규모 강좌를 추가 개설하고 의무화하는 한편, 현장 초동 업무를 수행하는 지역경찰의 전문성 강화를 위한 교육 시행과 함께 성폭력 범죄 피해자의 심리적 회복을 위해 피해자 신변보호 제도의 완화가 검토되어야 한다.

영문 초록

A sexual violence crime is a combination of violent acts on the opposite sex, physically, physically, and lawfully, and sexual contact against the other's will. Sexual violence crimes are more difficult to recover than other crimes.In addition, sexual violence is not limited to primary damages, and it is exposed to various secondary damages by criminal justice agencies during investigation. Therefore, in this study, we analyzed the victims' perception of the second damage and the perception difference of investigators through the study of the persons engaged in the investigative agency pointed out as the stage of the second damage, I looked for a solution. The perceptions of victims of sexual violence crime and investigators were found to be significantly different on the causes of the secondary damage of sexual violence crime. Victims of sexual violence crime reported that there were secondary injuries in a wide variety of areas including investigative procedures, investigators, victim protection and support systems, and media attitudes. On the other hand, investigators pointed out that the second damages can not arise due to the current laws and regulations, and the feelings of the victims are inevitable in the structure of the investigation, and that the media has no direct responsibility for the investigation. However, victims and investigators have a similar view on the effectiveness, professionalism and lack of education of lawyers. These results show that the victims of sexual violence crime are very sensitive to the secondary damage, while investigators still show a passive attitude. As an alternative to the problems mentioned above, I would like to propose “amendment of laws and system and expansion of education”. In addition, the 'Victim Rights Notice System' to enhance the victims' access to information should be improved to match the level of the victim, and the organization and personnel should be expanded to support the victim protection team. Also, in order to protect the victims from the early stage of the case, the appointment time of the counsel must be adjusted before the police investigation. Finally, in order to improve the awareness of investigators, it is necessary to additionally provide small scale classes on the topic of protection and support of victims. In addition, education for the enhancement of professionalism of local police performing initial work on the field and education of psychological recovery of victims of sexual violence crime The mitigation of the victim protection system should be reviewed.
