整治跨境电信网络诈骗犯罪对策研究

국문 초록

Criminals are increasingly leveraging modern technology to commit cross-border fraud, posing serious threats to society. As a result, it is imperative to strengthen the governance of such cross-border telecom and online fraud crimes. However, due to the transnational nature of these crimes, their organized structure, and the digitalization of criminal tools, public security and judicial authorities face considerable challenges in evidence collection, suspect apprehension, and the recovery of illicit funds. To address these issues, China should adopt the following measures to improve relevant systems: First, promote the digitalization of cross-border evidence documentation and accelerate the response speed for electronic evidence collection to enhance the evidence-gathering system. Second, intensify research on repatriation procedures, summarize successful experiences in voluntary repatriation efforts, and improve repatriation and persuasion mechanisms to effectively apprehend criminals. Lastly, by refining existing treaties and strengthening international cooperation, China can optimize its current asset recovery system.

영문 초록

犯罪分子运用现代科技手段实施跨境诈骗行为，其行为具有严重的社会危害性，因此必须加强对此类跨境电信网络诈骗犯罪的治理。然而，由于此类犯罪具有跨境化、有组织化以及犯罪工具的数字化等特点，导致公安司法机关在调查取证、抓捕犯罪分子以及赃款的追缴方面存在极大的困难。为此，中国应采取以下措施完善相关制度：首先，推动跨境取证文书的电子化，并加快跨境电子取证的响应速度来完善取证制度；其次，加强对遣返程序的研究，总结劝返成功经验，完善遣返与劝返制度以有效抓获犯罪分子；最后，通过完善既有条约并加强国际合作，优化现有的追赃制度。
