국문 초록

본 연구는 전세계약의 실태를 조사·분석하고, 전세계약의 문제점을 도출하여 개선방향을 제시하는 것이 연구의 목적이다. 본 연구에서 전세계약의 문제점을 도출하기 위해 전세의 현황과 전세사기의 실태, 전세사기의 유형 등을 제시하였고, 연구의 신뢰성을 위해 국가기관에서 진행한 통계자료를 이용하여 전세계약의 문제점을 도출하였다. 조사 결과, 전세사기 피해 상황 다수가 임대인 사칭이었고, 유형은 전세 보증금 보증보험의 안정성을 이용한 기망행위로 확인되었다. 또한, 공인중개사의 범죄 가담, 직업윤리 및 도덕성 상실, 신뢰도의 하락으로 발생하는 연쇄적인 문제들을 확인할 수 있었다. 이에 본 연구에서는 전세계약 문제의 주요 원인을 공인중개사와 전세제도의 구조로 집중하여 연구를 진행하였으며, 개선방향을 다음과 같이 제시하였다. 첫째, 공인중개사의 교육, 지도·단속을 통해 인식을 개선하고, 중개보수 바우처 제도를 시행하여 접근성을 높여야 할 것이다. 둘째, 임대인 표준심사 제도를 시행하여 전세계약 시 요구되는 필수 정보를 한눈에 볼 수 있게 해야 할 것이다.

영문 초록

The objectives of this study were to investigate and analyze the conditions of jeonse contracts and identify associated issues to propose improvement directions. This study presented the status of jeonse, the actual situation of jeonse fraud, and the types of jeonse fraud. This study also identified the issues associated with jeonse contracts by using statistical data from national organizations to secure the reliability of results. The results revealed that the majority of jeonse fraud cases involved impersonating a landlord, and the most common fraud type was a deceptive practice that exploited the stability of the jeonse deposit guarantee insurance. It was also confirmed that there was a chain of problems caused by the criminal involvement of licensed real estate agents, loss of professional ethics and morality, and decline in trust. Therefore, this study treated licensed real estate agents and the structure of the jeonse system as the main causal factors of jeonse contract issues and focused on these two items. This study suggested the following improvement directions. First, it would be necessary to improve awareness through training, instructing, and supervising licensed real estate agents and to increase accessibility by implementing a voucher system for brokerage fees. Second, it would be needed to implement a standardized landlord screening system to provide an overview of the essential information required for a jeonse contract.
