국문 초록

이 연구는 헌법과 법률을 통해 구체화되고 있는 청소년의 정치적 기본권의 의미와 쟁점을 정리하고, 청소년의 정치적 기본권 보장을 위한 법제도의 개선 방안을 제시하는 것을 목적으로 한다. 청소년의 정치적 기본권 논의에서 선거권 연령과 정당가입 연령 하향은 피상적인 단면에 불과하지만, 관련 법률 개정 이후 후속 논의는 좀처럼 진척되지 못하고 있다. 지난 2020년과 2022년에 걸쳐 개정된 ｢공직선거법｣과 ｢정당법｣에 따라 법률로 유보된 일부 청소년의 정치적 기본권이 확장되었다고 할 수 있다. 그러나 선거운동의 제한, 18세 미만 청소년의 정당 가입시 법적대리인의 동의 요구, 19세 이상 국민투표권 부여 등과 같이 동일한 연령 기준을 고려해야 하는데도 여전히 정비되지 못한 관계 법률 조항이 확인된다. 또한, 청소년이 일상에서 정치 활동에 참여할 수 있도록 주민자치회위원 자격 연령 하향, 학교운영위원회 구성에 학생위원 포함, 청소년참여위원회의 대표성 확보, 청소년참여위원회의 정책의사결정 참여 등에 관한 규정의 정비도 검토 대상이다. 나아가 무엇보다 청소년이 동료 시민으로서 성숙한 민주주의를 실천할 수 있도록 직접 참여의 기회, 그리고 그 교육의 기회를 확대하는 일이 중요하다고 본다.

영문 초록

This study aims to examine the meaning and key issues of adolescents’ political fundamental rights as embodied in the Constitution and statutes, and to propose reforms to the legal and institutional framework for their protection. While lowering the voting age and the minimum age for party membership has often been highlighted in discussions on adolescents’ political rights, these remain only superficial aspects, a nd s ubseq uent d ebates h ave scarcely a dvanced since the relevant legislative amendments. Following the revisions of the Public Official Election Act and the Political Parties Act in 2020 and 2022, certain political rights of adolescents that had previously been reserved by law have been expanded. Nevertheless, inconsistencies remain in related provisions that should apply uniform age standards, such as restrictions on electioneering, the requirement of legal guardian consent for party membership under the age of 18, and the granting of referendum rights only to those aged 19 and older. Further consideration is required for reforms that would allow adolescents to participate in political activities in everyday life, including lowering the age threshold for membership in residents’ self-governing councils, including student representatives in school management committees, ensuring the representativeness of youth advisory committees, and enabling their participation in policy decision-making. Above all, it is essential to expand opportunities for direct participation and political education so that adolescents may practice mature democracy as fellow citizens.
