국문 초록

본 연구는 스포츠 인권침해가 발생하였을 때 피해 확산을 막고, 추가 피해를 예방하기 위한 합리적인 ‘신고제도’와 ‘피해자를 보호’하기 위한 법정책적 대안을 제안하는 것을 목적으로 한다. 이러한 목적을 달성하기 위하여 우선 신고의 의미가 무엇인지 정의를 내리고, 현재 운영되고 있는 신고제도를 살펴보았다. 그리고 신고를 증진시키기 위해서 혹시 신고를 저해하는 요인 또는 촉진하는 요인이 있는지 학술연구를 통해 고찰해 보았다. 또한, 스포츠인들이 신고를 못 하는 이유가 무엇인지 살펴보았다. 이러한 내용들을 토대로 다음과 같은 법정책 대안을 제안하였다. 스포츠 현장에서 인권침해에 대한 합리적인 신고제도와 피해자 보호를 위해서는 우선, 신고자 측면에서 ‘신고자 신변보호, 신고자 포상제도, 피해자의 지속적인 운동환경 보장’을 제안하였다. 둘째, 가해자 측면에서 ‘가해자에 의한 보복 대처, 가해자에 대한 엄중한 처벌 감시자 역할, 가해자 대상 교정 프로그램 운영’을 제안하였다. 셋째, 기관 측면에서 ‘아동학대 신고 실행의도 확산, 인권교육의 방향성 점검, 대응사례 공유, 신고업무의 효율화를 위한 지부 설치, 종목단체의 인권보호센터와 스포츠윤리센터의 관계성 정립, 학교 내 신고 업무 활성화, 특별사법경찰관 제도 도입, 그리고 회복적 경찰 활동 활성화’를 제안하였다.

영문 초록

This study aims to propose reasonable legal and policy measures for a reporting system that prevents the spread of harm and protects victims when human rights violations occur in sport. To achieve the purpose, the study first defines the concept of reporting and examines the existing reporting systems currently in place. Additionally, it explores, through academic research, whether there are any factors that hinder or facilitate reporting. The study also investigates the reasons why individuals in the sports community may be reluctant to report incidents. Based on these findings, the study suggests the following legal and policy alternatives. First, from the perspective of the reporter, it is crucial to ensure the protection of whistleblowers, implement a reward system for reporters, and guarantee a stable training environment for victims. Second, from the perspective of the perpetrator, measures should be in place to prevent retaliation by offenders, strengthen oversight to ensure strict punishment for perpetrators, and implement corrective programs for offenders. Third, from the institutional perspective, the study recommends expanding the intent to report child abuse, reviewing the direction of human rights education, sharing best practices in response to human rights violations, establishing regional branches to enhance the efficiency of reporting operations, defining the relationship between the Human Rights Protection Center of sports organizations and the Sports Ethics Center, promoting reporting mechanisms within schools, introducing the special judicial police system, and fostering restorative policing efforts.
