국문 초록

본 연구는 프랑스의 공경비와 민간경비의 제도 및 현황에 대해서 역사적 배경과 제도적 특성을 살펴보는데 그 의의가 있다. 프랑스는 역사적으로 중앙집권적인 정치체제를 유지하여 왔고, 시큐리티 측면에서도 중앙집권적 국가경찰 제도를 유지하면서 보완적으로 자치경찰제를 도입하여 운영하고 있다. 국가경찰은 조직적, 분권적, 기능적 특성을 가지고 있다. 조직적 특성으로는 내무부 소속의 국립경찰과 국방부 소속의 헌병경찰로 나누어지고, 분권적 특성으로는 국립경찰과 헌병경찰의 관리영역과 업무영역에서 나타나고 있다. 기능적 특성은 국립경찰과 파리경찰, 그리고 자치제 경찰의 역할 등에서 나타나고 있다. 프랑스는 전통적으로 국가가 사회질서유지와 시민생활의 안전을 책임져야 한다는 사명감을 가지고 있다. 따라서 경찰력의 중앙집권화는 국가기반의 존립의 문제이고 정부에 대한 시민의 신뢰문제로 간주되고 있다. 프랑스는 공경비의 발전에 비해 민간경비는 상대적으로 발전이 저조하였다. 프랑스의 민간경비가 본격적으로 발달하기 시작한 것은 1983년 민간경비업이 법적으로 제도화되면서 부터였다. 다른 선진국에 비해 제도적 장치 마련이 늦은 것은 사실이지만 그 발전의 속도는 다른 국가들을 능가하였다. 이는 프랑스의 민간경비가 제도적으로 정착되기 이전에 민간경비 자체가 영업활동을 하고 있었고 또한 내·외부적인 요인으로 인한 발전의 우호적 기회가 주어졌기 때문이다. 특히 유럽의 통합은 민간경비 시장의 확대를 가져왔고, 통합으로 인한 자본의 자유로운 이동은 인수·합병을 통해 민간경비업체의 규모화를 이룩하는 기회로 작용을 하였다. 2006년 현재 프랑스는 4,600여개의 민간경비회사에 149,800여명의 경비원, 43억 8천 유로의 총 매출액을 기록하고 있다. 이는 2001년의 2,500여개 회사와 107,00여명의 경비원과 비교하였을 때 괄목할 만한 성장을 이룩한 것이다. 프랑스는 중앙집권적인 공경비 제도을 유지하면서 보완적으로 자치체 경찰이나 민간경비제도를 활용하여 최상의 치안질서유지와 시민생활의 안전을 기하려고 한다. 특히 사회주의적 정치체제를 유지하고 있는 프랑스의 전통사상은 국가안위와 국민생활의 안정과 만족에 그 목적을 두고 있다. 따라서 민간경비는 시민생활의 안정에 대한 국가의 보조적 장치로서 장려될 것이며, 통합유럽의 거대시장은 민간경비의 발전에 무한한 기회로 작용될 것이다.

영문 초록

The purpose of this study is to know the public security and the private security system, and their historical background also institutional character of the France. French political system has been sustained by a centralization of power in their history, and they have systematic character same time decentralization system with the dispersion of function. The French public security system has been developed with their politic and history as a centralization system. Therefore, they believed that the preserve public peace and good order and secure civic life would be protected by the nation. The nation also was charged with a mission for the secure civic life. It is national duty and responsibility to keep social order. Thereby, the strongly centralization system was required all aspects of society such as politic and public security system in France. To date, the centralization system sustain in political field and national institution. On the other hand, the private security system and its industrial sector has been developed very slowly in comparison to the public sector because of centralization system. Nonetheless, private security steady maintained by minimum required. That private security began in earnest develop when the private security law was legislated in 1983. It was so late compare to other developed countries such as England, U.S.A. and Japan even to Korea. Since then the private sector in security have led to remarkable development. According to an article “Sécurité Privée” in 2009, there are 4,600 security companies including 149,800 employees and the gross proceeds reached about 4,380 million euro in 2006 in France. The reason why the private security progress is increasing criminal and reach the limit police power. France maintains traditional centralization system in public security and adopts complementary cooperation with autonomous local system and private security system for the preserve public peace and good order and secure civic life. Especially, French democratic socialism emphasize national defense with ensure civil security, this is French traditional ideology. So, the private security industrial is in with a shout of developing in the future with public sector by national encourage in France.
