인터넷상 사이버모욕죄 도입에 대한 언론보도 내용분석 - KINDS 신문보도를 중심으로

국문 초록

본 연구는 인터넷상의 명예훼손과 모욕에 대한 언론보도의 형태가 최근 어떻게 보도되고 있는지에 대한 내용분석이 목적이다. 2008년, 2009년, 2010년 12월까지의 최근 3년간의 일간지 또는 주관지에 인터넷상의 명예훼손과 모욕에 대한 언론보도 형태를 통해 나타난 문제점을 파악하고 그에 대한 정책적 제안 및 시사점을 제시하는데 있다. 최근 인터넷 문화는 우리 생활 속에 깊숙한 곳까지 침투하여 자리를 잡고 있다는 점에서 본 연구는 인터넷상의 사회문제방지를 위한 사이버모욕죄의 도입과 관련하여 정책이슈화 과정과 정책결정에 중추역할을 수행하는 언론보도 대한 보도경향을 분석하고자 한다. 이러한 분석을 토대로 첫째, 언론보도가 사이버모욕죄에 대해 어떠한 시각을 가지고 있으며, 언론보도행태에 어떤 특성을 갖는지를 살펴보고자 하였다. 둘째, 정보통신정책과 관련하여 언론사별 논조의 차이가 드러난다면 언론사별 이념과 어떠한 관련이 있는지 알아보았다. 연구결과 사이버모욕죄 도입에 따른 보도는 동일한 현상을 두고 각 신문사가 어떻게 달리 보도하고 있는지를 여실히 보여주었다. 찬성과 반대를 표명한 언론사의 의도에 따라 사이버모욕죄 도입의 실체를 각기 다르게 전달했고 다른 의미를 부여하였다. 사이버모욕죄 도입에 대한 찬성론자들은 갈등과 대립을 확대하고자 하였고, 반대론자들은 사이버모욕죄 도입에 대한 정부의 준비소홀과 여론의 반대를 내세우면서 연기할 것을 주장하였다. 이와 같이 각 신문사들의 언론보도행태가 사이버모욕죄을 어떤 상태로 인식하고 있느냐를 반영하고 있는 것이며 이러한 인식들이 이후의 보도태도의 방향을 설정하는데 커다란 영향을 미치게 된다는 것을 알 수 있었다. 다시 말해 언론매체의 보도에 따라 국민들의 여론과 인식이 달라질 수 있다는 데에 주목해야 한다. 사이버모욕죄의 도입에 대한 타당성 홍보 강화뿐만 아니라, 국민들에게 올바른 사회문화의식을 형성하기 위해서는 언론매체의 공정하고 전문적인 보도가 필요하다.

영문 초록

The purpose of this paper is to content analysis about recently the press report of the news about introducing the “Act on punishing insulting behaviors on internet”. The problem of showing up in the daily newspaper weekly of for 3years(2008, 2009, 2010) recently through the news examine for introducing the “Act on punishing insulting behaviors on internet” and to suggest the personal perspective on the issue. Recently, the internet culture penetrates into the deep place into our inside of life and fixes. The report tendency treated the news performing the role of a center in connection with introducing the “Act on punishing insulting behaviors on internet”, for the social problem protection of the Internet policy issue process and decision making. For the based on this analysis, Frist, “Act on punishing insulting behaviors on internet” is to examine a kind of characteristic in the press report behavior. Second,The difference of the press company by deep-tone of an argument is found in connection with policy(information and communication), it can confirm with the press separation by the ideology whether there is any related or not. According to the research introducing the “Act on punishing insulting behaviors on internet” showed clearly having the same phenomenon how each newspaper company reported differently. The substance of introducing the “Act on punishing insulting behaviors on internet” was differently delivered according to the intention of the press company expressing an agreement for and against. The advocates about introducing the “Act on punishing insulting behaviors on internet” tried to expand a conflict and opposition. Opponents insisted government the negligent preparation and public opinion. Likewise, the press report behavior of each newspaper companies recognized “Act on punishing insulting behaviors on internet” as any kind of state, it reflected that these recognitions set up the direction of the later reporting attitude and it has the big influence. In other words, according to the report of the press media, it has to pay attention to that the public opinion and recognition of the nations can be changed.
