공동주택대표회의 선거의 문제점과 개선방안

국문 초록

아파트 관리민원 가장 많은 것이 동대표 선출 등 입주자대표회의 구성에 관한 것이다. 본 연구는 공동주택관리의 부정과 비리의 출발점은 공동주택대표회의의 선거에 있다는 문제인식에서 연구를 진행하여 공동주택대표회의 선거의 문제점을 선거의 원칙을 중심으로 실제로 관찰하여 살펴보고 이에 대한 개선방안을 제시하여 보았다. 문제점을 해결하기 위한 개선방안으로 공동주택 선거관리위윈회의 공직선거관리위원회의 참여 의무화에 대한 입법화 및 이에 따른 예산지원의 필요성을 언급하고 현재 사용자(세입자)에게 공동주택대표회의에의 피선거권이 없는 것을 피선거권이 있도록 조정되어야 한다고 주장하였다. 이 경우 소유권자의 이익이 침해되는 것을 막기 위해 필요한 제도적 보완장치를 언급하였다. 다음으로 공직선거관리법에 준하는 선거규율을 법령으로 구체적으로 규정하여 선거의 원칙이 지켜져야 하는 점을 주장하고 방문투표의 문제점을 해결하기 위한 제도적 보완사항을 언급하고 처벌규정의 구체화와 온라인(모바일)투표와 같은 바랄직한 제도의 도입을 주장하였다.

영문 초록

1. CONTENTS (1) RESEARCH OBJECTIVES The purpose of this study is to analyze the problem in apartment representative election system and to present the improvement scheme of it which is focused on the principles of election. (2) RESEARCH METHOD Legalㆍinstitutional approach methods, man to man interview methods and social research analysis method were employed as the research method. (3) RESEARCH FINDINGS The findings could be summarized as follows: First, it is necessary to enforce public election commission to take part in the apartment representative election by law. Second, the households who rent the apartment need the eligibility for apartment representative election. Third, the scheme for preventing the apartment election committee from committing corruption and irregularities must be established. Fourth, the good system such as mobile or on-line election system needs to be installed. 2. RESULTS This study has its significance in that it presented the policy improvement scheme for apartment representative election. and I think it is the basic solution to eradicate the corruption and irregulation in the apartment management in Korea.
