국문 초록

선거구획정은 대의민주주의의 대표성과 공정성을 결정하는 핵심 요소이며, 그 절차적 정당성은 국민의 참정권 보장과 직결된다. 우리나라는 1994년 선거구획정위원회를 도입한 이후 국회의 영향력 축소와 정치적 중립성 강화를 위해 선거구획정위원회의 구성과 지위를 개선해 왔다. 그러나 제22대 국회의원 선거구획정 과정에서도 나타났듯이, 의원정수 확정의 지연, 특례선거구 인정, 지역 간 인구 불균형 등 제도적 한계가 여전히 드러났다. 본 연구는 선거구획정위원회의 법적 지위와 권한을 검토하고, 실제 운영상의 문제점을 분석한 뒤, 개선 방안을 제시한다. 주요 개선 방안으로는 ① 선거구획정위원회의 상설화 및 독립성 강화, ② 시도별 지역구 정수 산정의 법제화, ③ 선거구획정안 확정 절차의 명확화를 제안하였다. 이러한 논의는 선거구획정 제도의 합리적 개선을 통해 국민의 투표가치 평등을 실현하고, 대의민주주의의 정당성과 신뢰성을 제고하는 데 기여할 수 있을 것이다.

영문 초록

Electoral district delimitation is a core element determining the representativeness and fairness of representative democracy, and its procedural legitimacy is directly linked to safeguarding citizens' right to participate in elections. Since introducing the Electoral District Delimitation Commission in 1994, South Korea has revised the commission's composition and status to reduce the National Assembly's influence and strengthen its political neutrality. However, as evident in the redistricting process for the 22nd National Assembly election, institutional limitations persist, including delays in finalizing the number of seats, recognition of special electoral districts, and regional imbalances. This study examines the legal status and authority of the Redistricting Commission, analyzes operational issues, and proposes improvement measures. Key improvement proposals include: ① making the Commission permanent and strengthening its independence; ② legislating the calculation of district seats per province/metropolitan city; and ③ clarifying the procedure for finalizing redistricting plans. These discussions can contribute to realizing equal voting value for citizens and enhancing the legitimacy and trustworthiness of representative democracy through rational improvements to the redistricting system.
