국문 초록

본고는 2024년 미국 제3순회항소법원의 Anderson v. TikTok 판결이 제시한 알고리즘 플랫폼 책임의 새로운 법리를 분석하고, 한국법에의 시사점을 도출한다. 10세 소녀가 틱톡의 추천 알고리즘을 통해 위험한 블랙아웃 챌린지 영상을 시청한 후 사망한 사건에서, 법원은 알고리즘 추천을 ‘플랫폼 자체 표현(first-party speech)’으로 인정하여 통신품위법 Section 230 면책을 제한했다. 이는 기존의 광범위한 플랫폼 면책 논리에 제동을 건 획기적 판결이다. 한국 헌법학적 관점에서 이 사안은 플랫폼의 표현의 자유와 이용자의 생명권·안전권, 기업의 영업의 자유와 소비자의 알 권리 간의 기본권 충돌 문제로 귀결된다. 한국 헌법재판소의 실제적 조화 원리와 비례원칙 4단계 심사는 이러한 복합적 기본권 충돌에서 체계적 해결 기준을 제공할 수 있다. 민법적 차원에서는 기존 불법행위법의 확장적 해석을 통해 플랫폼의 방조책임 법리를 알고리즘 추천 영역에 적용할 수 있으나, AI 시스템의 예측불가능한 특성을 충분히 반영하지 못하는 한계가 있다. 특별법적 차원에서는 제조물책임법의 알고리즘 적용과 아동보호를 위한 특별 의무 체계 구축이 시급한 과제로 부상했다. Anderson 판결은 증명책임과 정보 접근권 문제를 통해 기존 법체계의 한계를 드러내면서, 새로운 접근법의 필요성을 제시했다. 아동 보호를 중심으로 한 플랫폼 투명성 강화, 알고리즘 책임성 제고, 효과적인 피해구제 체계 구축이 국제적 공통 과제로 부상하고 있다. 한국법도 기존 법리의 창조적 해석과 근본적 제도 개선을 병행하여 혁신과 규제의 균형을 찾는 새로운 모델을 제시해야 할 시점에 이르렀다.

영문 초록

This study analyzes the new legal framework for algorithmic platform liability established by the Third Circuit Court of Appeals' Anderson v. TikTok decision in 2024 and derives its implications for Korean law. In the case where a 10-year-old girl died after viewing dangerous Blackout Challenge videos through TikTok's recommendation algorithm, the court recognized algorithmic recommendations as “first-party speech” of the platform, thereby limiting Section 230 immunity under the Communications Decency Act. This landmark decision represents a significant brake on the existing broad platform immunity framework. From a Korean constitutional perspective, this case involves conflicts between fundamental rights: the platform's freedom of expression versus users' right to life and safety, and corporate freedom of business versus consumers' right to know. The Korean Constitutional Court's principles of practical concordance and the four-step proportionality test can provide systematic resolution criteria for such complex fundamental rights conflicts. From a civil law perspective, while platform liability for aiding and abetting can be extended to algorithmic recommendation areas through expansive interpretation of existing tort law, there are fundamental limitations in adequately reflecting the unpredictable characteristics of AI systems. From a special law perspective, urgent tasks include applying product liability law to algorithms and establishing special duty systems for child protection. The Anderson decision highlighted limitations of existing legal systems through issues of burden of proof and information access rights, presenting the need for new approaches. Enhanced platform transparency, improved algorithmic accountability, and effective damage relief systems centered on child protection are emerging as common international tasks. Korean law has reached a point where it must combine creative interpretation of existing legal principles with fundamental institutional improvements to establish a new model that balances innovation and regulation.
