일제강점기 한인(韓人) 국적(國籍)에 대한 고찰

국문 초록

2024년 여름 정치권에서 불거진 일제강점기 당시 한인들의 국적(國籍)을 둘러싼 논란은 한동안 우리 사회를 뒤흔들 정도로 뜨거운 감자였다. 그 당시 한인들의 국적은 대체 어떻게 규정할 수 있을까? 본 연구는 이러한 질문에 대한 답을 찾고자 시작됐다. 이에 따라 먼저 국적의 개념을 정의하고 한인들의 국적을 법적으로 고찰해 보고자 했다. 일제가 한인들을 일본 국적으로 편입시킨 법적 근거는 1910년 8월의 ‘한일강제병합조약’이었다. 그러나 병합조약은 체결 과정에서 국제법적으로 불법·부당한 측면이 많아 원천 무효로 보는 것이 타당하다는 시각이 지배적이다. 따라서 법적으로 한인들은 일본 국적이 될 수 없었으며, 한반도에 주권국가가 존재하지 않았으므로 한인들의 국적은 ‘무국적’ 상태였다고 할 수 있다. 다음으로 한인들의 법적 지위에 대한 주요 국가들의 인식을 살펴봤다. 일본은 한인들에게 자신의 지망에 따라 귀화를 허용하는 국적법을 적용하지 않았다. 동시에 외국 귀화를 금했던 대한제국의 법률을 인용하여 한인들이 일본 국적에서 벗어날 수 없도록 구속했다. 프랑스는 대체적으로 일본의 논리를 수용, 한인들을 일본 국적자로 인식했다. 중국과 미국의 경우 시기에 따라 한인들을 일본 국적자로 보기도 하고, 일본과 구분되는 별개의 법적 지위로 인정하기도 하는 등 입장이 단일하지는 않았다. 예외적으로 러시아는 한인들을 일본인들과 구분되는 별개의 법적 지위로 간주했다. 마지막으로 우리의 국적을 회복하기 위한 한인들의 노력에 주목했다. 한인들은 자신들의 일본 국적을 부정하고 한국 국적을 회복하기 위해 국제사회를 상대로 외교적 독립운동을 전개했다. 1943년 카이로선언 역시 일본과는 다른 국적, 정체성을 가진 이들이라는 점을 강조하며 독립운동을 전개한 결과 얻어낸 성과라 할 수 있다. 이를 통해 국권은 상실했으나 한국인이라는 정체성을 지켜내려고 했던 한인들의 노력과 성과를 재조명할 수 있었다.

영문 초록

The controversy over the nationality of Koreans during the Japanese colonial era, which erupted in the political sphere in the summer of 2024, was such a hot potato that shook Korean society for some time. Then, what were the nationalities of Koreans at the time of Japanese colonial era? This study was undertaken to find answers to such questions. Accordingly, This study first sought to define the concept of nationality and to examine the nationality of Koreans from a legal perspective. The legal basis upon which Japan incorporated Koreans into Japanese nationality was the “Korea-Japan Annexation Treaty” of August 1910. However, since the process of concluding this treaty involved numerous unlawful and unjust aspects under international law, the prevailing view is that it should be deemed null and void from the outset. Therefore, legally speaking, Koreans could not have become Japanese nationals, and since no sovereign state existed on the Korean Peninsula, it can be said that Koreans were in a state of “statelessness.” Next, this study examined how major countries perceived the legal status of Koreans. Japan did not apply its Nationality Act, which would have allowed Koreans to naturalize at their own will. At the same time, it invoked the laws of the Korean Empire, which prohibited foreign naturalization, to ensure that Koreans could not escape from Japanese nationality. France generally accepted Japan’s reasoning and regarded Koreans as Japanese nationals. In the case of China and the United States, positions were not unified, such as considering Koreans as Japanese nationals and recognizing Koreans as having separate legal status from the Japanese. Exceptionally, Russia regarded Koreans as having a distinct legal status apart from the Japanese. Finally, the study highlighted Koreans' efforts to restore their nationality. Koreans have campaigned for diplomatic independence toward the international community in order to regain Korean nationality, away from Japanese nationality. The Cairo Declaration of 1943 was a great achievement that emphasized that Koreans are different in nationality and identity from Japanese. This gives a glimpse into the efforts and achievements of Koreans who have made efforts to preserve their identity as Koreans despite the loss of national sovereignty.
