국문 초록

본 연구는 잉글랜드의 전통 ‘퍼블릭 스쿨’이 중세 말 자선신탁 형태의 교육기관으로 출발하여, 공통법과 형평법의 교차 속에서 법적 변천 과정을 거쳐 현대적 학교 법인으로 발전해 온 역사를 심층적으로 분석한다. 특히 럭비 스쿨을 중심 사례로, 2010년 제정된 학교 정관과 함께 유언장, 왕실 칙허장, 의회법 등 핵심 1차 사료를 검토하며, 이를 클래런든 9개 학교라고 불리는 유수의 퍼블릭 스쿨들과 비교 분석한다. 퍼블릭 스쿨의 법적 구조는 공통법상 법인격과 재산 소유권, 형평법상 신탁 관리 원칙 및 수탁자의 충실 의무라는 이중 법적 틀 안에서 형성되며, 이는 학교의 자율성과 공익성 사이의 균형을 유지하는 핵심적인 법적 기제로 작용한다. 본 연구는 1864년 클래런든 위원회 보고서와 1868년 퍼블릭 스쿨 법을 분석하여, 이러한 법적·제도적 변천 과정이 학교 운영 구조와 자선 의무에 미친 영향을 검토한다. 또한 시프레 원칙의 적용과 2006년 자선단체법 이후 ‘공익성’ 개념의 법적 재해석이 럭비 스쿨 정관에 구체적으로 어떻게 반영되었는지를 분석하여, 법적 연속성과 제도적 적응 과정을 규명한다. 본 논문은 이러한 법제사적 고찰을 통해 국가 개입과 기관 자율성이 균형을 이루는 영국 특유의 ‘공-사 혼합형’ 다원주의 교육 모델을 조명하고, 자선의 법적 정의, 엘리트 교육의 역사적 토대, 신탁 기반 거버넌스의 현대적 함의에 대한 학술적 논의에 기여하고자 한다. 나아가, 공공성과 사적 유산의 교차점에서 운영되는 교육기관에 대한 비교사적 분석틀을 제시함으로써 국내외 관련 연구에 이론적 통찰을 제공한다.

영문 초록

This study provides an in-depth legal-historical analysis of the institutional formation and evolution of public benefit in England’s traditional Public Schools, tracing their transformation from medieval charitable trusts into modern educational institutions through complex legal developments. Focusing on Rugby School as a principal case study, the research examines key primary sources, including its 2010 Statutes, wills, royal charters, and parliamentary acts, while also conducting a comparative analysis with the other public schools of the 9 Clarendon Schools. The legal structure of Public Schools operates within a dual legal framework, where common law principles govern corporate status and property ownership, while equity law enforces fiduciary duties within charitable trusts. This study explores the Clarendon Commission Report (1864) and the Public Schools Act (1868) to assess how these legal transformations influenced school governance and institutional autonomy. Furthermore, the research analyzes the application of the cy-près doctrine, as well as the reinterpretation of the public benefit principle following the Charities Act (2006), identifying how these legal concepts are embedded within Rugby School’s statutes to ensure continuity and institutional adaptation. Through this exploration, the study sheds light on England’s distinctive model of educational pluralism based on ‘public-private hybrid’ system, in which state intervention and institutional autonomy maintain a dynamic equilibrium. It aims to contribute to academic discussions on the legal definition of charity, the historical foundations of elite education, and the contemporary governance of trust-based institutions. Additionally, by examining the intersection of public responsibility and private legacy, the paper offers a comparative analytical framework for educational institutions operating within diverse legal and historical contexts.
