국문 초록

With its randomness and interest, the blind box economy has risen rapidly, and has quickly combined with other industries to become an emerging sales model favored by consumers. With the continuous expansion of industry boundaries, this marketing method not only stimulates the vitality of the market, but also exposes more and more legal problems, which makes the legitimate rights and interests of consumers suffer major infringements. Based on the definition of the nature of blind box trading contracts and the in-depth study of the Guidelines for the Code of Conduct for Blind Box Business (Trial) issued by the State Administration for Market Regulation, this paper provides appropriate suggestions for the protection of consumer rights and interests in combination with the current development status of the blind box economy, so as to better regulate and guide the development of China’s blind box economic market and protect the legitimate rights and interests of consumers.

영문 초록

盲盒经济凭借其随机性和趣味性迅速兴起，极速地与其他行业领域相结合，成为备受消费者青睐的新兴销售模式。随着行业边界不断拓展，这种营销方式在激发市场活力的同时，也暴露出愈来愈多的法律问题，使消费者合法权益遭受了重大侵害。本文在对盲盒交易合同性质进行界定以及对国家市场监督管理总局发布的《盲盒经营行为规范指引（试行）》深入研究的基础上，结合当下盲盒经济的发展现状，为消费者权益保护提供适当的建议，以此更好地规范和引导我国盲盒经济市场的发展，从而保护消费者的合法权益。
