국문 초록

The supervision of the National People’s Congress is an important driving force for urban renewal. The supervision and empowerment of urban renewal by the National People’s Congress is a manifestation of the exercise of state power by the people and a manifestation of the theory of people’s sovereignty in urban renewal. To ensure the smooth progress of urban renewal, it is necessary to call on the entire population to actively participate in urban renewal, which reflects the value of the theory of public participation. The supervision and empowerment of urban renewal by the National People’s Congress has enriched the connotation of national development theory and also promoted the development of government service theory. The Constitution provides the fundamental basis for urban renewal, while laws and local regulations such as the Legislative Law provide normative basis for urban renewal, providing a systematic basis for urban renewal from macro to micro levels. The supervision and empowerment of urban renewal by the National People’s Congress still face problems such as insufficient practical efforts in local regulations to assist urban renewal, serious formalization drawbacks in the deliberation of urban renewal reports and plans by the National People’s Congress, weak practical supervision of urban renewal by local people’s congresses, insufficient daily discussions by the Standing Committee of the National People’s Congress on urban renewal, and low effectiveness of in-depth research by representatives of the National People’s Congress at all levels. The National People’s Congress should provide more sufficient basis for urban renewal through the formulation of local regulations, supervise urban renewal through the review of various reports and plans, provide opinions and suggestions on law enforcement in urban renewal, and discuss major issues in urban renewal by the Standing Committee of the National People’s Congress. It should also exercise the power of National People’s Congress representatives to conduct research and inspection, and supervise urban renewal.

영문 초록

人大监督是城市更新的重要推动力。人大监督赋能城市更新是人民行使国家权力的体现，是人民主权理论在城市更新中的体现。为确保城市更新的顺利进行，应号召全民积极参与城市更新，体现了民众参与理论的价值。人大监督赋能城市更新丰富了国家发展理论的内涵，也推动了政府服务理论的发展。《宪法》为城市更新提供了根本依据，《立法法》等法律和地方性法规为城市更新提供了规范依据，从宏观到微观为城市更新提供了体系化的依据。人大监督赋能城市更新还存在地方性法规助力城市更新的实践力度不足、人大审议城市更新报告和计划的形式化弊端严重、地方人大对城市更新的实践监督力度不强、人大常委会对城市更新的日常讨论不充分和各级人大代表深入调研的有效性不高等问题。人大应当通过制定地方性法规的形式为城市更新提供更充分的依据，通过审议各类报告和计划的方式监督城市更新，对城市更新中的执法情况提出意见和建议，人大常委会对城市更新中的重大事项进行讨论，为城市更新指明方向，还应当落实人大代表调研与视察权力，监督城市更新。
