국문 초록

Current criminal law academic achievements pay little attention to China’s Environmental Judicial Interpretation in 2023. In the contents of the provisions of China’s Environmental Judicial Interpretation in 2023, the highlights of the interpretation are increasing the punishment of environmental crimes and the rationalization of some provisions. However, there are still some practical problems in China’s Environmental Judicial Interpretation in 2023, such as confusion between wrongfulness and responsibility, violation of the principle of equality, analogy and confusion of the meaning of provisions, which bring great difficulties to the identification of environmental pollution crimes in judicial practice. Following the original intention of legislation and adhering to the principle of statutory punishment for crimes is the obligatory stance of China’s Environmental Judicial Interpretation in 2023. On the basis of a clear interpretation of the position, China’s Environmental Judicial Interpretation in 2023 should be further improved, including the deletion of provisions that cannot be refined, such as liability elements, analogical provisions, etc. The provisions that can be refined should be retained, and the meaning of the provisions should be clarified in combination with the knowledge of criminal law doctrine, so as to standardize the identification of environmental pollution crimes in judicial practice.

영문 초록

现有刑法学术成果对2023 年中国《环境司法解释》极少关注。纵观2023 年中国《环境司法解释》的条文内容，加大环境犯罪的惩治力度、部分条文内容趋于合理化是该解释的亮点所在。但是，2023年中国《环境司法解释》依然存在混淆不法与责任、违反平等原则、类推条文含义、条文含义混同的现实问题，这给司法实务中污染环境罪的认定带来了较大困境。遵循立法原意、坚守罪刑法定原则是2023年中国《环境司法解释》的应然立场。在明确解释立场的基础上，应进一步完善2023 年中国《环境司法解释》，包括删除无法细化的条文如责任要素、类推条文等；对于能够细化的条文，应当保留，并结合刑法教义学知识明确条文含义，以规范司法实务中污染环境罪的认定。
