국문 초록

스토킹행위는 개인에게 신체적·정신적 피해를 초래하고 사회에도 큰 불안을 주는 범죄이다. 스토킹범죄는 가해자의 자기중심적 사고, 공감능력의 부족, 정신분열증이나 편집증, 경계성 인격장애, 왜곡된 현실의 인식 등으로 행동·심리가 복잡하므로 단순한 엄벌만으로 범죄를 예방하기 어렵다. 따라서 스토킹범죄의 예방을 위해서 효과적인 평가와 치료 대책을 검토하여 보다 적극적인 개입이 필요하다. 현행 ｢스토킹처벌법｣상의 응급조치, 긴급응급조치 등에 치료적 요소가 내포되어 있다면, ｢스토킹처벌법｣상 금지명령을 내리기 이전의 단계부터 경찰의 치료적 개입을 강화할 수 있다. 본고는 ｢스토킹처벌법｣상의 스토킹행위를 방지하고 피해자를 보호하며 가해자가 다시 범죄를 저지르는 것을 막는 치료적 경찰활동을 제언한다. 이를 위해 스토킹행위를 의학적 측면에서 치료가 가능한 문제로 인식하고 그에 따라 치료적 경찰활동의 정의, 목적, 주요 요소를 정립하여 그 근거를 제시한다. 그리고 이를 바탕으로 스토킹범죄에 대한 치료적 효과를 얻을 수 있도록 지원자로서 경찰의 역할, 통합적 상담, 전문인력의 확보, 회복적 경찰활동의 확대 등으로 치료적 경찰활동의 방향에 대하여 제언한다.

영문 초록

Stalking is a crime that causes physical and mental damage to individuals and causes great anxiety in society. Stalking crimes are difficult to prevent crimes with simple severe punishment because the behavior and psychology are complex due to the perpetrator's self-centered thinking, lack of empathy, schizophrenia or paranoia, borderline personality disorder, and distorted perception of reality. Therefore, more active intervention is needed by reviewing effective evaluation and treatment measures to prevent stalking crimes. If therapeutic elements are included in emergency measures and emergency measures under the current ｢Stalking Punishment Act｣, the police's therapeutic intervention can be strengthened from the stage before the injunction is issued under the ｢Stalking Punishment Act｣. This paper proposes therapeutic police activities that prevent stalking under the ｢Stalking Punishment Act｣, protect victims, and prevent perpetrators from committing crimes again. To this end, stalking behavior is recognized as a curable problem from a medical perspective, and the definition, purpose, and main elements of therapeutic police activities are established and the basis is presented accordingly. In order to obtain therapeutic effects on stalking crimes, the direction of therapeutic police activities is suggested by the role of the police as a supporter, integrated counseling, securing professional manpower, and expanding restorative police activities.
