중국 특색의 반부패 10년(2012-2022년)에 대한 소고

국문 초록

1978년 개혁개방 이후 중국 공무원의 부정부패 문제는 매우 심각한 수준이다. 경제 성장은 중국 공산당의 국가 통치에 대한 정당성의 기반이 되었으나, 관료 사회에서의 부정부패는 빠른 경제 성장과 함께 점점 더 큰 사회문제가 되었다. 후진타오(胡錦濤)는 중국 공산당 제17기 중앙위원회를 대표하여 시진핑(習近平)에게 게 주요 정치 과제 중 하나인 부정부패 척결의 문제를 넘겨주었다. 시진핑은 강력한 반부패 운동을 실시하기 위해 공산당 중앙기율검사위원회의 권한을 강화하였지만, 당 외부에 독립적인 부패 및 사법기관을 설립하는 것을 거부하고 있다. 중국의 반부패 노력이 효과가 있었는가? 그리고 중국은 악성 범죄를 처벌하고 부패를 용인 가능한 수준으로 근절한다는 목표를 달성했는가? 선별적 법 집행에 대한 의구심이 커지면서 부패 척결을 위한 더 많은 조치가 정치적 투쟁으로 가려지고 있는 실정이다. 본고에서는 중국 공산당 고위 지도부의 공개적인 반부패 선언, 시진핑 10년(2012~2022년) 동안 중국공산당이 선포한 부패 처벌 법률 및 규정, 중국 최고인민법원의 업무 보고서 및 관련 데이터, 국제투명성기구가 발표한 데이터, 중국 공산당 공식 매체가 발표한 '반부패' 내용에 대해 고찰하였다.

영문 초록

The problem of official corruption in the People's Republic of China, after the reform and opening up in 1978, was extremely serious and worsening. In fact, the economic growth became the party state's legitimacy foundation to rule. Since then, the corruption has become a growing problem with the fast economic growth. Hu Jintao, on behalf of the Seventeenth Central Committee of the Chinese Party of Communist, handed over one of the major political tasks to Xi Jinping to solve the problem of corruption. Xi Jinping enforced the power of the party's Central Commission for Discipline Inspection to fight corruption, but he still rejects to establish an independent incorrupt and judiciary institution outside the party. Whether the anti-corruption effort waged by China is working? Did it meet its objective of punishing the malignant and eradicate corruption to an acceptable level? As more doubts on the selective law enforcement grows, more of the action of fighting corruption is over shadowed with political struggles. The information source of this paper includes open declaration of anti-corruption from the high leadership level of Chinese Communist Party, corruption punishment laws and regulations proclaimed by Chinese Communist Party during these 10 years(2012-2022), work reports and related data of the Chinese Supreme People Court, data released by Transparency International, “anti-corruption” subject content announced by the official media of Chinese Communist Party, etc.
