영토분쟁 지역에 대한 일본 정부 접근법의 비교연구

국문 초록

이 글은 현재 일본 주변에서 나타나고 있는 북방영토, 조어대(센카쿠 열도), 독도라는 3지역의 영토분쟁에 대하여 일본정부가 어떠한 입장을 취하면서 접근하고 있는지, 그리고 이에 대응하는 각국의 입장은 무엇인지를 비교분석해 보는 데에 그 목적이 있다. 나아가 이 연구를 통해 이 지역의 협력을 저해하고 있는 영토문제의 해결을 위한 하나의 방향을 모색해 보고자 한다. 필자는 이들 영토문제를 역사적 배경, 국제법적 배경, 정치적 배경이라는 3 측면에서 살펴보았다. 우선 영토문제에 대한 역사적 배경은 왜 이들 지역이 문제시되고 있는지에 대한 검토를 통하여 문제발생의 배경과 양측의 주장을 명확히 하려는 데에 있다. 두 번째로, 이들 영토분쟁지역이 갖고 있는 국제법적 논쟁점은 무엇인지를 살펴보았다. 마지막으로, 각국이 접근하고 있는 정치적 측면에서의 입장은 어떠한가에 대한 분석이다. 이 연구를 통하여 나타난 바를 요약하면 다음과 같다. 첫째, 북방영토의 경우 계속적으로 바뀌어온 양국의 관할권 변화, 그리고 보다 직접적으로는 제2차 세계대전 이후 나타난 냉전의 산물이었다. 이는 샌프란시스코 강화조약에서 명기된 북방영토 경계의 규정에서 그대로 나타났다. 그러나 탈냉전 들어 나타난 국제적인 긴장완화로 러일 양국은 조금 다른 면모를 보여주고 있다. 러시아의 경우 경제적 측면에서의 교류를 중심으로 북방영토문제에 접근한다면, 일본의 경우 영토협상과 경제지원, 인적 교류 등을 망라한 다차원적인 입장에서 접근하고 있다. 두 번째로, 조어대의 경우 1969년 국제연합의 해양자원조사로 경제적 가치가 부각되면서 양국간의 현안으로 급격히 부상되는 양상을 보였다. 북방영토와는 다르게 조어대의 경우 탈냉전 들어서도 계속 이 지역의 불안요인으로 남아있다. 이는 탈냉전 이후 동북아 지역에서 나타나고 있는 중일간의 지역패권다툼과 얽혀 계속 해결점을 찾지 못하고 있다. 마지막으로, 독도의 경우 양국간의 팽팽한 자기 주장에도 불구하고 물리력이나 국제법에 호소하기 보다는 협상을 통한 정치적인 해결을 모색하는 방향을 보이고 있다. 결론적으로, 동북아 지역의 영토분쟁에 대한 접근에 있어서 역사적, 국제법적 측면에서의 접근 보다는 경제적 측면에서의 접근이 정부와 민간 수준에서 구현될 때 역내국가간 협력의 실현가능성이 현실화될 수 있을 것이다.

영문 초록

The purpose of this paper is to examine the territorial issues-the Kurile Islands, Senkaku Islands(Taio-yu-tai) and Tokdo(Liancourt Rocks)-among the Northeast Asian Countries. Through this study a scheme to increase the cooperation among the Northeast Asian Countries can be drawn out. For this purpose, three aspects of each territorial disputes-historical context, international law and political aspect-are examined. The results of this paper are the following. First, modification of the Kurile boundary occurred four times and the present border dispute between Russia and Japan stems from this historical situation. Furthermore, the legal status of the Kurile Islands which has been defined in the San Francisco Peace Treaty is not clear, too. As a result, the Soviet Russia government and the Japan government have confronted with each other as far as the Nothern Islands are concerned. However, there are some changes in the dispute over the Nothern Islands between Russia and Japan in the 1990s. The economic approaches rather than historical or political approaches are taken by not only the two government level but also the regional administration and local residents. Second, in contrast to the Northern Islands between Russia and Japan, the confrontation on the Senkaku Islands between China and Japan has been still continuing. This is partly from the struggle for regional hegemony between China and Japan in spite of the end of the Cold-War. Third, the Tokdo dispute which has been the long-pending question between Korea and Japan has been developing toward the economic settlement rather than confrontation in terms of historical or legal aspect. In a nutshell, it would be fair to say that the strengthening of the cooperation among Northeastern Countries can be possible through the economic approach-not the historical or legal approach-as far as the territorial disputes concerned.
