국문 초록

복잡하고 계속적인 계약에서 당사자의 책임 없는 사유로 인하여의 계약의 기초가 되었던 사정이 변경되어 변경된 사정에 따라 이행을 강제하는 것이 현저하게 불합리한 경우 당초 계약의 내용에 따른 이행의 문제를 해결하기 위한 방법이 각국마다 제각각의 법리를 두어 해결해오고 있어 통일된 해결 기준이 없기 때문에, 복잡하고 계속적인 국제거래가 정상적으로 이행되지 않으면 그 문제가 심각하게 발생하게 되는 것이다. 이러한 문제를 해결하기 위하여 국제적으로 독일을 비롯하여 각국에서 사정변경의 원칙을 명문으로 규정하고자 한다는 점, 우리나라에서 CISG를 조약으로 인정하고 있으나 명문으로는 아직 규정하지 않고 있다는 점에서 볼 때, 사정변경의 원칙에 관한 국제적인 계약규범의 흐름에 대한 본 연구는 민법개정안을 논의하는 중요한 기초자료가 될 것이다.

영문 초록

The international transaction was amplified by developing the means of the traffic and the technology of communications, such an international transaction is mostly the continual contract those mostly want to be lived up to long-pending continually. Such a international transaction is often difficult to live up to just like a original contract because the circumstances is changed by an incident that is no one can foresee what will happen in the future. For introducing the Hardship, the discussion is preceded about the principles of the change of circumstance of other country and the international principles. Then more right and fit idea is presented. Each country solves the issue that is the changed of circumstance. In our country, the most scholar insist to introduce "Hardship" but the principle is recognized only a derivative principle and it is not ordained civilly. A leading case does not recognized Hardship but even then a leading case is judged by hardship as Hardship is not an article. Recently some cases are under a bias toward to be judged by hardship. This is a rebutting evidence for to introduce Hardship.
