국문 초록

최근 세계화의 심화와 함께 세계경제통합이 가시화되면서 지역무역협정(regional trading agreements; RTAs)의 체결이 급속하게 증가하는 추세를 보이고 있다. 국내의 이해단체들(대중)과 경제환경을 지배하는 정치조직간의 밀접한 유대가 지역협정의 주요 매력으로 간주되어 그것이 다자간 무역협정 보다 RTAs가 성행하는 이유 중 하나로 생각할 수 있다. 이런 관점에서 이 연구의 문제인식은 통상 분쟁해결절차에 대한 대중의 접근성 인정이 과연 RTAs의 장점이 될 수 있는가 하는 것이다. 우리는 본 논문에서 다자간 협정과 지역간 무역협정의 차이를 분쟁해결절차에 대한 대중참여 허용 여부로 구별하여, 그것이 정부의 자유무역협정 선택 행위에 어떤 영향을 미칠 수 있는지 그 함축성을 추론하고자 하였다. 분석은 통상 분쟁절차에 대한 대중의 참여가 정부로 하여금 통상협정의 선택을 제한할 수 있음을 보인다. 이는 분쟁해결에 대한 대중참여 확대가 지역무역협정에 바람직스럽지 못한 결과를 가져올 수 있음을 의미한다. 이 사실은 다시 현실에서 RTAs의 체결이 우리의 직관만큼 순조롭게 진행되지 않을 수도 있음을 시사하는 것이다. 그러므로 국가간 이해관계가 복잡하게 얽히는 다자간협상보다 쌍무적 협정 혹은 소수의 몇 개 나라가 진행하는 지역협정이 상대적으로 더 쉽게 체결될 수 있을 것 같은 우리의 직관을 유보시키는 하나의 공식적 이유를 이 논문은 제시한다.

영문 초록

The global trading system is in a state of flux today. While the setting up of the WTO as a replacement for GATT promises a new era of strengthened multilateralism, the progress towards global liberalization is likely to remain slow and uneven. Meanwhile, regionalism has been gaining momentum in recent years. With this background, we focus on one particular feature that distinguishes the regional trading arrangements(RTAs) from the multilateralism trading system - the difference in the public's access to the arrangements' dispute settlement mechanism. The most FTAs allow the public - unions, business groups or NGOs - some measure of access to the agreement's dispute settlement procedure. The good examples are public communication, citizen's submission or public participation, and investor-state dispute in a labor, environmental and investment issues. The public do have some ability to press complaints under the rules of FTAs. With a simple model of divergent government and the public, we show that the public's access to dispute resolution mechanism will limit the scope of agreements signed. This suggests that greater access by the private parties to dispute settlement is not a desirable features of regional agreements compared to multilateral agreements. This result holds our expectation that RTAs will be signed promptly relative to the multilateral trading system which is intricate in interests among countries.
