국문 초록

본 연구는 문헌조사와 2012년 1월 26일부터 2월 26일까지 수행한 현지조사를 바탕으로 모로코 이마지겐(흔히 말하는 베르베르의 복수)들의 관습법 중 형법 내용을 밝히는데 있는데, 특히 본 연구는 모로코 아틀란스 산맥 중부에 거주하고 있는 지아얀이마지겐의 형법내용을 밝히고자 한다. 즉 모로코 이마지겐의 관습법 즉 이즈레프 내에서 형법체계와 형법내용은 어떠한가를 밝히고, 자이얀 이마지겐 형법체계는 모로코 현행법과 어떠한 관계에 있고, 그 위상은 어떠한 가를 밝히고 자 한다,본 논문은 자마아를 통하여 이루어지는 이마지겐 형법의 기초가 되는 개인의 도덕적 가치와 사회의 도덕적 가치에 기반을 둔 정의의 개념을 다룬다. 이마지겐 관습법 상의 정의는 아네흐캄이라는 제도에 의하여 실현된다. 이후 이 논문은 이마지겐 관습법 내 형법의 기반과 범죄와 형벌의 종류를 다룬다. 이와 함께 토지 및 결혼에 관련된 범죄와 형벌이 다루어진다. 이후 이 논문은 형벌에 관한 모코로의 실정법에 기초한 형벌과 이마지겐 관습법에 기초한 형벌이 다루어지면서 그 차이점도 함께 다루어진다. 즉 모로코의 형벌체계 내에서 이마지겐 형벌이 작동되고 있음이 밝혀진다. 이러한 맥락에서 이마지겐 형벌 체계는 모로코 실정법 내의 형벌체계 내에서 점점 약해지고 있다는 것이 밝혀진다. 하지만 이마지겐 ‘정체성 찾기’ 운동으로 점점 이마지겐 관습법 체계 내에서 형벌체계의 인식이 재고되고 있다는 것을 밝힌다.

영문 초록

The Imazighen custom law system affects the Imazighen way of life. An Amazigh customary legal system has been set up over thousands of years in the North Africa covering all the aspects of life. In fact, there were custom laws regulating individual, collective, cultural and political life, and the system of ownership of lands, forests, waters and minerals, and penalties for crimes, for example, criminal code, libel, theft, commit adultery, marriage etc. And this paper deals with the types of the penalties for crimes in the Imazghen customary law. Namely this paper deals with the bases of the criminal code, the types of crimes and penalties including diya(reparation) against body demage, libel, theft, faithless marriage, and commit adultery, marriage and the other penalties in the Imazighen custom laws. And this paper deals with the difference between Imazighen Custom Law and Moroccan Law of the penalties for crimes. In this context, the Imazighen customary law is weaken because the Moroccan government forces the Imazighen to obey the Moroccan positive law including the penalties of crime. In conclusion, recently the Imazighen penalty system is recognized due to the Imazighen identity movement.
