환경난민을 둘러싼 주변국의 입장과 대응방안

국문 초록

많은 화산 지진 전문가들은 백두산 화산 폭발을 기정사실화하고 있다. 백두산 화산이 폭발할 경우 많은 인명피해와 대량의 환경난민이 발생할 것으로 예상된다. 환경난민의 경우 기존의 난민규정으로는 난민으로 인정받기 어려운 실정이다. 백두산 화산폭발로 인하여 대규모 환경난민이 발생하는 경우, 북한 이탈주민이 난민으로 보호받을 수 있도록 국제적 차원에서 다시 난민 규정에 대한 재정의(再定義)하는 방안, 지역적 협정을 통해 난민을 인정하는 범위를 확대하는 방안, 대량난민을 난민으로 인정하는 국제관례에 따른 해석, 국제 난민법에서 정하고 있는 난민 구성요건을 폭넓게 탄력적으로 해석할 필요가 있다고 판단한다. 백두산 화산이 폭발하면 대량 환경 난민 수용과 관련하여 주변국 간의 외교적 갈등이 비화될 가능성이 높다. 대량 환경난민의 문제는 어떤 한 국가의 힘만으로는 해결하기 힘들다. 화산 폭발이후 발생될 대규모 난민처리와 급변상황에 대한 해결을 위해서 국제협력은 불가피하다. 한국을 비롯한 주변국들은 난민할당제를 도입하고, 주변국들이 조기경보체제를 확립하여 난민문제에 선제적으로 대응할 준비가 되어 있다면 그 피해와 난민 수용에 대한 갈등과 혼란을 최소화 시킬 수 있다고 본다.

영문 초록

Today, many volcanologists view the possible eruption of Mount Baekdu as fait accompli. Should it happen, the eruption of Mount Baekdu will cause both massive casualties and trigger environmental refugees on a wide scale. However, current laws concerning refugees create challenges in recognizing environmental refugees. Against this backdrop, it is necessary to amend existing laws to protect North Korean refugees at the international level, including: the redefinition of the term “refugees”; expanding the conceptual scope of refugees through regional agreements; recognizing mass refugees through customary international law; and allowing greater flexibility in the interpretation of current international laws on refugees. The eruption of Mount Baekdu is likely to trigger diplomatic conflicts among regional states concerning the fate of the environmental refugees. It is difficult for any one state to single-handedly deal with environmental refugees. International cooperation in therefore critical to effectively deal with mass refugees and the dramatic circumstantial changes triggered by the eruption of Mount Baekdu. Against this backdrop, Korea and regional stakeholders should work together to implement refugee allocation regimes and early warning systems. Although it is impossible to completely prevent the damages and environmental refugees caused by volcanic eruptions, the chaos and conflicts caused by the disaster and refugees can be minimized if Korea and regional states preemptively work together.
