국문 초록

본고는 『범망경』 십중계의 범죄를 이루는 네 가지 구성요건인 ‘인(因)·연(緣)·법(法)·업(業)’을 바탕으로 신라 승려 원효, 의적, 승장, 태현의 입장을 분석하였다. 원효는 『마하승기율』 등 한역 율장을 두루 고려하고 있다. 반면 의적, 승장, 태현은 『유가사지론』 본지분의 「보살지」와 같은 유가계본(瑜伽戒本)이 아니라 『유가사지론』 섭결택분의 「유심유사등삼지」(권59)에 나오는 십악업도의 다섯 가지 조건 ‘사·상·욕요·번뇌·방편구경’을 인용하고 있다. 의적은 이를 『범망경』의 인·연·업·법 중 ‘연’을 설명할 때만 활용한다. 반면 승장은 더욱 적극적으로 『범망경』의 구성요건은 무시한 채 『유가사지론』 권59의 다섯 가지 조건만을 주로 활용한다. 의적은 『범망경』의 인·연·업·법 해석에 『유가사지론』 권59 다섯 가지 조건을 배대하지만, 이 다섯 가지 조건에 본인의 해석을 통해, ‘방편구경’은 ‘방편’과 ‘구경’으로 나누고, ‘욕요’ 역시 '의요'로 바꾸는 응용을 가한다. ‘범행의 구성요건’의 분석은 행위와 동기를 어떻게 포착할 것인지 하는 윤리학적 가치판단의 토대가 될 것이다. 현재까지도 영향력을 지니는 『범망경』의 주석 전통 속에는 ‘행위’, ‘동기’, ‘방법’, ‘결과의 달성 여부’ 등이 이미 체계적으로 분석되어 있다. 본고의 연구를 통해 신라 주석가들의 입장이 살해행위를 일으킨 의도, 범죄행위 이전에 발생한 업의 여부, 인등기심을 통한 수증론적 차이 등을 발견할 수 있다. 대승보살계를 대표하는 『범망경』의 중범죄 구성요건에 대한 논의가 ‘동아시아 불교윤리학 연구’의 확립에 일조할 수 있기를 기대한다.

영문 초록

This study analyzes the perspectives of the Silla monks Wonhyo (元曉), Uijeok (義寂), Seungjang (勝莊), and Taehyun (太賢) on the four elements of crime in the Ten grave Precepts of the Brahma’s Net Sutra (Ch. Fanwang jing, 梵網經): “Cause” (因), “Condition” (緣), “Method of conduct” (法), and “Completion of a case” (業). Wonhyo considers various texts, including the Mahāsāṃghika Vinaya (摩訶僧祇律) , while Uijeok, Seungjang, and Taehyun place significant emphasis on the five conditions of the “Ten Evil Acts” (十惡業道) in volume 59 of the Yogācārabhūmi-śāstra(Ch. Yuqie shidi lun, 瑜伽師地論) when interpreting the elements of crime. Rather than referring to the Yogācārabhūmi-śāstra or its commentary on the Bodhisattva Path (菩薩地), they focus on these five conditions: “affair” (事象), “ideation” (想), “intention” (欲樂), “affliction” (煩惱), and “complete method” (方便究竟). Uijeok exclusively applies these conditions when explaining the element of “Condition” (緣) in the Brahma’s Net Sutra. In contrast, Seungjang largely disregards the structural elements of the Brahma’s Net Sutra and predominantly relies on the five conditions from volume 59 of the Yogācārabhūmi-śāstra. Uijeok incorporates these five conditions to interpret the Brahma’s Net Sutra’s elements of “Cause”, “Condition”, “Method of conduct”, and “Completion of a case”, while also offering his own interpretation. Notably, he subdivides the “complete method” (方便究竟) into “method” (方便) and “completion” (究竟) and alters “intention” (yule, 欲樂) to “intention” (yiyao, 意樂). The analysis of the elements of a crime serves as a foundational framework for ethical value judgments regarding the interpretation of actions and motives. Within the exegetical tradition of the Brahma’s Net Sutra, which remains influential to this day, key components—Cause”, “Condition”, “Method of conduct”, and “Completion of a case”—have already been systematically analyzed. The discussions on the grave crimes in the Brahma’s Net Sutra, a representative text of the Mahāyāna Bodhisattva Precepts, are expected to contribute to the establishment of East Asian Buddhist ethics as a scholarly field.
