경찰일탈의 효율적 관리에 관한 연구 : 미국 내 조기경보시스템(EWS)을 중심으로

국문 초록

경찰은 다른 법집행기관과는 달리 대민업무를 일상적으로 수행하기 때문에 부패를 비롯한 일탈행동을 범할 여지가 높으며 일탈행동이 외부로 노출될 가능성 또한 높다. 게다가 경찰의 일탈행위에 대한 비난은 해당 경찰관 개인에게 그치는 것이 아니라 경찰조직에 대한 신뢰도를 무너뜨린다는 점에서 심각하게 인식할 필요가 있다. 그럼에도 불구하고 현재 경찰은 일탈행동을 효율적으로 통제하지 못하고 있다. 경찰관들의 일탈행동에 대한 대응책으로 주로 감찰과 징계에 의존하고 있지만 이러한 제도는 경찰관의 일탈행동을 예방하는 사전적 기능보다 일탈행동을 적발하고 처벌하는 사후적 역할에 머물고 있다. 그래서 이 연구는 미국 내에서 경찰에 대한 효율적인 인사관리도구로 평가받는 조기경보시스템(Early Warning Systems: EWS)을 검토하고자 하였다. 조기경보시스템은 경찰관들의 일탈행동을 확인하기 위해, 또한 일탈방지를 위한 사전개입에 활용될 수 있도록 개인정보를 데이터베이스화 한 인사관리도구이다. 조기경보시스템은 일탈적 행동을 보이는 경찰관을 확인하고, 교정을 위해 개입하며, 개입 후 모니터링을 하는 3단계로 구성된다. 이 연구에서는 조기경보시스템의 운영사례로써 Miami-Dade Police Department의 Early Intervention Systems(EIS), Phoenix Police Department의 The Personnel Assessment System(PAS), Western Australia Police의 Early Intervention Systems(EIS)을 살펴보았다. 사례연구는 조기경보시스템이 경찰관의 일탈행동을 억제할 뿐만 아니라 경찰조직에 대한 신뢰도 향상에도 기여함을 보여주었다. 이 연구에서는 조기경보시스템에 대한 검토를 바탕으로 경찰의 일탈을 견제하는 관리도구로서 국내에 적용 가능한 조기경보시스템의 도입을 제안하였다. 조기경보시스템의 성공적인 도입을 위하여 몇 가지 제언을 덧붙였다.

영문 초록

Unlike other personnel in criminal justice agencies, police officers frequently confront with the temptation of corruption and deviant behaviors since they always meet the public. When it is publicized makes ruined the confidence of individual police officers and the entire agency. Although it is evident that controlling police deviance is one of the most important priorities, it is questionable for Korean police to control it efficiently. Since current anti-corruption strategies much more focus on post-disposal rather than prevention. Therefore, this study has an aim to introduce Early Warning Systems evaluated as one of the efficient controlling measure in the U.S police. EWS, a tool of police personnel management, is designed to intervene before breakin out police deviance by creating the database of police personnel. EWS has three-stages including identification, intervention, and post-monitoring. The study discuss three exemplary EWS cases such as Early Intervention Systems(EIS) of Miami-Dade Police Department, The Personnel Assessment System(PAS) of Phoenix Police Department, and Early Intervention Systems(EIS) of Western Australia Police. Case studies show that diverse EWS programs in the U.S police agencies have positive effects to prevent and deter police deviance as well as to promote police trust of the public. Based on the review of EWS programs, this study suggests Korean police to adopt EWS as a preventive measure of police deviance. For successive implementation of EWS in Korea, the author recommends several suggestions.
